Pursuant to the California Public Records Act, I hereby request the following records:

Emails sent/CC'd to or from Principal Jacob Haley between 7 November 2023 and 13 November 2023 containing the non-case-sensitive phrase "Free Palestine." If any of the emails contain attachments, please include those attachments as well.

If any part of the emails are exempt from disclosure, please be sure to review and release all reasonably segregable nonexempt portions of responsive documents. For example, if one of the emails contains personal information about a student, you send a copy of the email with the personal information redacted.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Exempt from disclosure and not provided are emails and memos that would reveal the District’s deliberative process per Government Code section 7928.410. "Under the deliberative process privilege, senior officials of all three branches of government enjoy a qualified, limited privilege not to disclose or to be examined concerning not only the mental processes by which a given decision was reached, but the substance of conversations, discussions, debates, deliberations and like materials reflecting advice, opinions, and recommendations by which government policy is processed and formulated." (San Joaquin LAFCO v. Superior Court (2008) 162 Cal.App.4th 159, 170-171.) The rule prohibiting inquiry into thought processes applies to local legislatures. (Oxnard Harbor District v. LAFC0 (1993) 16 Cal.App.4th 259, 271; Mike Moore's 24-Hour Towing v. City San Diego (1996) 45 Cal.App.4th 1294, 1305.)

Also exempt from disclosure and not included are records that discuss students. Student records are exempt from disclosure per Government Code section 7927.700 and Education Code section 49076. Please note the one name that was redacted was an individual outside of the district whose name was included as a recipient by inadvertence.

This response resolves the District’s obligation to respond to your request. This decision was made by Public Relations Officer Franco with the advice of legal counsel.
