Pursuant to the Connecticut Freedom of Information Act, I hereby request the following records:

Under the Connecticut Freedom of Information Act, Conn. Gen. Stat. § 1-200 et seq. All records related to Soleil Luna Meehan, DOB 01/13/2011, generated by Stamford/Norwalk Department of Children and Families, recent Family Assessment Response, involving the requesters daughter cited above. This includes, but is not limited to, any case files, reports, correspondence, notes, and electronic records generated between January 1, 2023 and November 14, 2023. If you are not the custodian of these records I request that you forward this request to the appropriate party within your agency. Under Connecticut Freedom of Information Act law this request has a response time of four days.

I also request that, if possible and pursuant to Conn. Gen. Stat. § 1-212(d), fees be waived as I believe this request is in the public interest and not made for commercial gain. The requested documents will be made available to the public at MuckRock.com.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Connecticut General Statutes Section 17a-28 which governs disclosure of the records of DCF defines records as "information created or obtained in connection with the department's child protection activities or other activities related to a child while in the care or custody of the department, including information in the registry of reports to be maintained by the commissioner pursuant to section 17a-101k."

Section 17a-28(b) states, "notwithstanding the provisions of section 1-210, 1-211 or 1-213, records maintained by the department shall be confidential and shall not be disclosed, unless the department receives written consent from the person or as provided in this section, section 17a-101g or section 17a-101k." Section 17a-101k extends the restriction on disclosure beyond DCF. That section states that "the information contained in the registry and any other information relative to child abuse, wherever located, shall be confidential, subject to such statutes and regulations governing their use and access as shall conform to the requirements of federal law or regulations."

Any records responsive to your request would have been obtained in connection with the Department’s child protection activities. As noted above, these records are confidential and excluded from disclosure under the Freedom of Information Act. The Department is denying your request under the FOIA.
