From: Matt Chapman

To Whom It May Concern:

Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

A copy of the following records for all past and current employees and contractors employed by this department. Please provide at least, but not limited to, 5 years worth of records.

Name
Email address
Title
Name of immediate superior
Email address of immediate superior
Direct reports (if applicable)

These records will be used to associate against a set of records of all employees provided by the Department of Innovation and Technology. As such, should any of the requested records be unavailable, please let me know at your earliest.

I request that the file format be an excel file.

Important note: This request has been sent to all 34 Chicago departments listed on Chicago's website. Neither the Department of Innovation and Technology nor the Department of Human Resources maintain information WRT immediate superiors, and so a request to all departments is necessary. If there are any methods from any department to accumulate all requested records from all of Chicago from a single location, I would much prefer to go that route, and will then promptly withdraw any remaining requests.

Relevant text from similar request to the DoHR:
"Concerning your request for manager, direct reports, and email addresses, please note that each
City department is a “public body” under Section 2 of FOIA, 5ILCS 140/2(a). See Duncan
Publishing, Inc. v. City of Chicago, 304 III. App. 3d 778, 784, 709 N.E.2d 1281, 1286 (1st Dist.
1999) (“Clearly, each of the individual departments are subsidiary bodies of the City and are ‘public
bodies’ as defined by the FOIA.”) A FOIA request must be directed to the department that
maintains the records you are seeking. The Department of Human Resources does not have
documents responsive to those portions of your request."

The records responsive to this request are invaluable for understanding the underlying structure of the City of Chicago and its internal operation. As a result, the public's interest for this information far outweighs any burden and associated costs.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Sincerely,

Matt Chapman

RE:  Chicago Public Schools FOIA Request N006135-012519
Dear Mr.Chapman: This letter is in reply to your Freedom of Information Act (FOIA) request seeking the following information: A copy of the following records for all past and current employees and contractors employed by this department.

RESPONSE : The Chicago Public Schools (CPS) FOIA Department has reviewed your request and determined that a lthough the CPS could pull the requested employee names, titles, and email addresses, specific information about supervisors and direct reports is not tracked in any existing database. Therefore, responding to your request would be extremely labor intensive and unduly burden the CPS by requiring the creation of records not maintained by the District in the ordinary course of business and answering questions outside the scope of the FOIA. In accordance with Section 1 of the FOIA, the CPS is not required to create documents in order to respond to a FOIA request Section 1 of the FOIA states in part: "This Act is not intended to create an obligation on the part of any public body to maintain or prepare any public record which was not maintained or prepared by such public body at the time when this Act becomes effective, except as otherwise required by applicable local, State or federal law." [5 ILCS 140/1] The requirements of the FOIA apply to public records “having been prepared by or for, or having been or being used by, received by, or in the possession of, or under the control of any public body.” [5 ILCS 140/2(c)]  Accordingly, and as determined in Kenyon v. Garrels, 184 Ill. App. 3d 28,32 (4 th Dist. 1989), the FOIA applies to the provision of existing public records; a public body is not required to answer questions or generate new records in response to a FOIA request.  Additionally, a FOIA request must reasonably identify a record(s) for review and not “a general request for data, information and statistics to be gleaned generally from documents which have not been created and which the agency does not generally create or require.” [ Kenyon v. Garrels, 184 Ill. App. 3d 28,32 (4 th Dist. 1989)]. Additionally, “A requester is entitled only to records that an agency has in fact chosen to create and retain.” [ Yeager v. Drug Enforcement Admin., 678 F. 2d 315, 321 (D.C. Cir. 1922)] You may wish to refer to the CPS Leadership Organization Chart, or the Employee position files, available at the following links: https://cps.edu/Leadership/Pages/organizationchart.aspx (https://u8387795.ct.sendgrid.net/wf/click?upn=Ow1KccipsoIsnXbuEgm-2FN04YdcpwXI3-2FFwzQD1eUV4CRq7W2wW9wJ6cRQ25qe0ciR-2F13m8e-2F8o5hTUDFlCfYvA-3D-3D_vJPhzSzv4Nt86hyrHyDacZI8f5q3-2BezEo0ExfqfXg7f5JhYMsTF3ksmwRu9imGj9CwFKm71aG-2Bh2cIEYBBVxWTC2v93PVF2DianJCsVbZEkaGqP-2FX2vHWHDy4GT1yLe0C-2BwxnNo4NkOcGJVm-2BhqHwX0ACmiqbTPtYEMeBBdoHjSyEDUUjNSHPj8Ekc-2FYGR0SbqDPT-2FQrzU-2F7BVKB1YZ0zeugWs1qdgz9jWzOPw8CCJpY4-2F2thJ-2B82zB8sm-2BuVPD-2ByuaDu1BSp9iRMq2syHYWbypzIiSa33MtZHEp38jKC4uHb1dfTnIh9odkZ9sMzaPmPtzw22CQRGV-2FMc8VCMMEbUyg5eTkbOKHAcoMcgZU4pmbaAaAWOTWGd4GR1bI0NeL) https://cps.edu/About_CPS/Financial_information/Pages/EmployeePositionFiles.aspx (https://u8387795.ct.sendgrid.net/wf/click?upn=Ow1KccipsoIsnXbuEgm-2FN5-2B-2BmNNYI7ogD1cN5yzR-2B-2BtljwkwPnDWcUo9RQJHZ8w3bSqGcZo6jzrBXtwwrQpsKHdpPu33hcHZmLfTehHvyOA0iIlB9jqVwC29YbcUXS-2BE_vJPhzSzv4Nt86hyrHyDacZI8f5q3-2BezEo0ExfqfXg7f5JhYMsTF3ksmwRu9imGj9CwFKm71aG-2Bh2cIEYBBVxWTC2v93PVF2DianJCsVbZEkaGqP-2FX2vHWHDy4GT1yLe0C-2BwxnNo4NkOcGJVm-2BhqHwX0ACmiqbTPtYEMeBBdoHjSyEDUUjNSHPj8Ekc-2FYGR0SbqDPT-2FQrzU-2F7BVKB1YZ0zeugWs1qdgz9jWzOPw8CCJqqjRGcXeEOroe4YBCu-2Feb68b-2Fvj-2FvSwFfU6itBUbGSNvv34fmhkyaFn4-2Fim2cooaexDH4ykRugd1ROjIwLVbjIhTEw4To41z7NCW1sT8QEOcOPlGz9OkG4DVP-2FkERTfU-2FTiqB1CPznJ2YdM1To6RXL) Note, the CPS is a separate agency from the City from the City of Chicago.
