Pursuant to the California Public Records Act, I hereby request the following records:

The College Board offers "a name list service" called the "Student Search Service®" which allows universities to buy information about students for $0.47 per name. Prior to August 31, 2019, the price was $0.45 per name.

Therefore, I hereby request the following records:

* Any and all contracts, purchase orders, invoices, receipts, and billing documents between the school and the College Board for the Student Search Service. This may include "consolidated billing" documents, which are default for all College Board search orders. Consolidated billing documents could include an invoice, a list of cost incurred for conducting the search order.

* Any digital communications including but not limited to emails and text messages) as well as documents, (including but not limited to PDF, word processing, excel, and slide documents) that mention the "Student Search Service" between January 1, 2016 and present.

* A copy of any privacy impact assessments, use policies, standard operating procedures, data retention policies, legal opinions, warranties, non-disclosure agreements, contracts, liability waivers, insurance agreements, Requests for Proposals, Responses to Requests for Proposal, Memorandums of Understanding, Letters of Interest, usage policies, or informal agreements between the school and the College Board that mention the Student Search Service.

* All instructional materials, presentations and presentation materials (including recorded video and audio, PowerPoint files, prepared remarks, and slides formats), and other guidance on the use of the Student Search Service. This includes A) any notes taken during meetings that discussed the use of the Student Search Service, B) any explanations (whether internally or externally generated) of how Student Search Service works, and C) any other document that has been used to help explain the use of the Student Search Service to any party, including internal documentation, public relations materials, and executive summaries.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

In accordance with relevant law and University policy, all records
identified as responsive to your request will be reviewed and made
available for your access.

Although the requested records have not yet been fully gathered and
reviewed, it is possible that the requested material may contain
information exempt from disclosure pursuant to the California Public
Records Act (CPRA). As such, we are extending the period to make the
determination pursuant to Government Code section 6253(c)(1), “the need to
search for and collect the requested records from field facilities or other
establishments that are separate from the office processing the request”;
and, Government Code section 6253(c)(3), “the need for consultation, which
shall be conducted with all practicable speed, with another agency having
substantial interest in the determination of the request or among two or
more components of the agency having substantial subject matter interest.”

However, this is not a determination that the information is necessarily
exempt from disclosure.

We anticipate a determination whether disclosable public records are within
the University’s possession no later than December 16, 2019. My office will
contact you as soon as a determination is dispatched.

and executive summaries."

A search for the information is underway. All records identified as
responsive to your requests will be reviewed, and made available for your
access, in accordance with relevant law and University policy.

Although the requested records have not yet been fully gathered and
reviewed, it is possible the requested material may contain information
exempt from disclosure pursuant to the California Public Records Act
(CPRA). However, this is not a determination that the information is
necessarily exempt from disclosure.

We anticipate the first set of records will be available for inspection
within eight weeks. Our office will contact you as soon as the records are
assembled. While you may inspect the records free of charge on campus
during a mutually convenient appointment time, please note that the
University is entitled to charge for the cost of document duplication for
any copies you may wish to retain.

RECORDS EXEMPT FROM DISCLOSURE

As explained in greater detail below, records if any, responding to your
following request are exempt from disclosure:

The University will not produce records that are privileged or otherwise
exempt from disclosure pursuant to California Government Code section 6254
(b) and (k). This includes documents pertaining to pending litigation or
claims, and documents protected by the attorney-client privilege, attorney
work product, and official information privileges. Moreover, we will not
produce documents exempt from disclosure under the deliberative process
privilege. See Times Mirror Co. v. Superior Court (1991) 53 Cal.3d 1325.

NO RECORDS EXIST

After a reasonable search, UCSC has determined that no records exist
responding to your requests for:
