This correspondence is in response to your online request form submission received by the California Department of Justice (DOJ), in which you sought records pursuant to the Public Records Act contained in Government Code section 7920.000 et seq. Specifically, you are seeking: "Documents related to Nova Tech, Cynthia Petion and Eddie Petion in relation to the Wisconsin Department of Financial Institutions and Division of Securities actions for case S-246552 (EX), and/or California Department of Financial Protection & Innovation Disast and Refrain Order pertaining to the same." For the reasons set forth below, we must decline your request.
The records that you seek are confidential law enforcement records of the Attorney General. Government Code section 6254, subdivision (f) expressly exempts from disclosure investigatory and security files of the Attorney General including complaints about unlawful practices. (See, Dick Williams v. Superior Court (1993) 5 Cal.4th 337, 354.) Investigative records do not lose their exempt status due to a failure to prosecute, or the close of an investigation. (Id. at p. 355.)
Sincerely,
Martin Goyette
California Department of Justice
