Good afternoon. This email shall respond to the Public Records Act (“PRA”) request below that was served via email on my client, the San Mateo County District Attorneys’ Office (“SMCDAO”), on January 26, 2022. The records you are requesting – “any and all search warrants affidavits, applications and return from search warrants, police reports, investigation reports, chronological reports, relating to Inspector Matthew Broad or any others involved in the investigation of suspect Kailin Wang” – are exempt records under the California Public Records Act.

Government Code section 6254 states in pertinent part: “Except as provided in Sections 6254.7<https://1.next.westlaw.com/Link/Document/FullText?findType=L&pubNum=1000211&cite=CAGTS6254.7&originatingDoc=ND69D2741C6AF11E8B9E0D2F6EE66D6F0&refType=LQ&originationContext=document&transitionType=DocumentItem&ppcid=2bb70d07bff441989028f6cc1fadeb26&contextData=(sc.History*oc.Document)> and 6254.13<https://1.next.westlaw.com/Link/Document/FullText?findType=L&pubNum=1000211&cite=CAGTS6254.13&originatingDoc=ND69D2741C6AF11E8B9E0D2F6EE66D6F0&refType=LQ&originationContext=document&transitionType=DocumentItem&ppcid=2bb70d07bff441989028f6cc1fadeb26&contextData=(sc.History*oc.Document)>, this chapter does not require the disclosure of any of the following records:… Records of complaints to, or investigations conducted by, or records of intelligence information or security procedures of, the office of the Attorney General and the Department of Justice, the Office of Emergency Services and any state or local police agency, or any investigatory or security files compiled by any other state or local police agency, or any investigatory or security files compiled by any other state or local agency for correctional, law enforcement, or licensing purposes….”

The SMCDAO is a local police agency and the records requested are records of investigations conducted by the SMCDAO as well as investigatory files compiled by the SMCDAO for law enforcement purposes. As such, these records are exempt under California’s Public Records Act and the SMCDAO elects to not produce them. (See also, e.g., Saunders v. Superior Court (2017) 12 Cal.App.5th Suppl. 1.)
