Derek's Phone Calls

Dear Chip Warren,

This letter is in response to your Public Records Act request dated September 13, 2022 in which you requested the following records:

"Pursuant to the California Public Records Act, we are requesting the recordings of phone calls made by Derek Martinez F68037 between 06/01/2021 and 08/31/22. Mr. Martinez is incarcerated at Correctional Training Facility (CTF) at Soledad. The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires."

The CA Department of Corrections and Rehabilitation is denying your request for public records because they are exempt from disclosure based upon the following exemptions:

Penal Code sections 11075, 11076, and 13102; Government Code section 6254(k)
California Code of Regulations title 15, section 3261.2(e); Government Code section 6254(k)
