To Whom It May Concern:

Pursuant to the California Public Records Act, I hereby request the following records:

AtNight Media (formerly Original Media Group) requests Calls for Service and E-mail Communications pertaining to The Walt Disney Studios and Hollywood Records located at 500 S. Buena Vista Street, Burbank, California 91521 (hereinafter referred to as the “Disney Companies”).

Request.
(1). Calls for Service to the Disney Companies between January 1, 2007 to January 1, 2017.
(2). Any e-mails received or sent by your Agency concerning allegations of sexual assaults that occurred or arose from the Disney Companies between January 1, 2007 to Present Day. If this section of the request seems broad, a search for emails containing the keywords “assault” and “Disney” during the specific period will suffice.

AtNight Media is a representative of the news media and is primarily engaged in the dissemination of information to the public.

If this request is unclear, please contact me to allow revisions rather than deny the request. Similarly, if the requested data are available only in part, please fulfill the portion of the request that is available rather than denying it in full. For example, notes or reports are available/subject to release but personal identifying information are not, reply with the report summary and omit sensitive information.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 calendar days, as the statute requires.

Sincerely,

Nik Hatziefstathiou

Good morning,

The below request is voluminous and broad.

1. CAD calls- to clarify, these are calls for service by the public or sometimes officer initiated. This is a document that includes dates, times, officer names, location, and type of call. This record documents the conversation between the citizen, officer, and dispatchers. At the location and timeframe you requested, there are 359 CAD calls. Each call is $5 for a total cost of $1,795.00. The fee must be paid in advance before the calls are individually printed and prepared for release. This will take Records Bureau staff approximately 3 months to prepare for release once we have received payment.
2. E-mails received and sent by BPD staff: there are approximately 300 PD employees. City IT will need to search each employee’s e-mail account for the past 10 years using the keywords your provided of “assault” and “Disney”. The keyword “assault” in a law enforcement environment can potentially be thousands of e-mails. I am unable to provide a timeframe for City IT to conduct this labor-intensive search. Once the e-mails have been given to the Records Bureau staff to prepare for release, this could take several months depending on how many e-mails there are.

Please consider significantly narrowing your timeframe for both requests. All PD employees is very broad for an e-mail search. Please consider narrowing down the employees or providing information on the event or assault you are inquiring about.

Thank you,

The keyword search is for both keywords in a single email (example: “There was a reported assault today at Disney. We took a report.”) What if we narrow #1 to Jan. 1, 2007 to Jan. 1, 2009? The fee for Calls for Service seems a bit excessive as this is a newsworthy topic about one of the largest brands in the world of entertainment.

From: Burbank Police Department

Our CAD system only has data going back to November 2008. From November 2008 through December 2009, there are 40 calls for service. The fee for these is $200. The Burbank City fee schedule can be found on the city website.

Burbank City has a 2-year e-mail retention policy. City e-mails are destroyed daily once they have reached 2 years and aged out. Please provide the date range for the e-mails. This information is required to conduct the e-mail search.

Let’s do the most recent two years—let me circle back with team on Calls for Service! Thanks again

From: Burbank Police Department

Thank you for the clarification. The two most recent years will start today and go back two years. I have submitted the timeframe and keywords to City IT to begin their process.

The CAD calls are pending the timeframe from you.

Good afternoon,

City IT advised that they are unable to do a city employee e-mail search by specific Department. They need to search by name. IT searched all city employees, approximately 1,500 employees, and they found 4,188 e-mails. Please specify which BPD employees you are requesting to be included in the e-mail search.

Thank you,

Just police personnel (officers, sergeants, lieutenants, captains, deputy chief, and chief, etc.). Or must it be specific individuals?

From: Burbank Police Department

Good morning,

I will check with City IT and see if this is possible.

Good afternoon,

The e-mail search using the parameters you provided below, yielded 697 e-mails. This is a large number of e-mails to read and prepare for release. This will take staff approximately 4 weeks to complete. You will receive a response no later than September 6, 2023.

What have you decided regarding the CAD calls?

Thank you,

Thanks for the update! Let me check with the team on the CAD. Can we narrow those down by nature? Perhaps we search specifically for police responding to the studios for reports of sexual assault or misconduct?

From: Burbank Police Department

Good morning,

As stated in my e-mail out of office response, I have been off work, and today is my first day back in the office.

I will look at the CAD calls and let you know how many there are pertaining to sexual assault or misconduct reports taken by BPD at the Disney Studio.

Good afternoon,

Thank you for the update to your original request.

The e-mails and CAD calls have been reviewed and there are none responsive to your request. Nothing for sexual assault or misconduct at the Disney Studio.
