To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

1) Copies of all notices of enforcement (as described in Article 80, Section 80B-8(7)c(i) of the Boston Zoning Code) that the Commissioner of Inspectional Services has sent since Jan. 1, 2017 to project applicants regarding a falsified disclosure statement or failure to file a disclosure statement. Please note, if multiple notices of enforcement were sent to different parties regarding one disclosure statement it is only necessary to provide one copy of the notice.

A description of the notices of enforcement can be found on page 60 of Article 80 of the Boston Zoning Code: http://www.bostonplans.org/getattachment/c4a33d0a-9718-409c-9614-cbc3ac694180. In response to a previous request, Inspectional Services informed me that the Boston Planning & Development Agency keeps these records.

I ask that all fees be waived as I am a journalist and I intend to use the requested records to disseminate information in the public's interest.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

The Boston Planning & Development Agency (BPDA), has received your March
30, 2018 request for public records. This letter shall act as the BPDA's
response to your request for public records. This response applies only to
records that exist and are in the custody of the BPDA. See A Guide to the
Massachusetts Public Records Law, p. 32, n.115.

Specifically, you requested:

The BPDA does not have any records responsive to your request.

Under Massachusetts law you may appeal this response to the Supervisor of
Records in the Office of the Secretary of the Commonwealth. G. L. c. 66, §
10A; 950 CMR 32.08.

Thank you for your response. Could you please clarify whether there are no responsive documents because no notices of enforcement were sent during the time period, or whether there are no responsive documents because BP&DA is not the custodian of those records?

Todd- I apologize for the delay I do not believe there have been any
enforcement actions. If there were any enforcement actions I’m not sure who
the custodian would be. I know you left me a voicemail message. Im happy to
discuss further next week.
