Pursuant to the Oregon Public Records Law, I hereby request the following records:

Materials related to and sufficient to show all instances of alleged or actual inappropriate or illegal behavior or actions resulting in compensation or expenditures involving this agency.

Responsive materials include records of all settlements (formal and informal) and payments to which this agency was or is a party for the period from January 1, 2010 through the date this request is processed. Responsive materials include those for matters and legal claims resolved prior to the initiation of any litigation.

In particular, materials responsive to this request include all reports, lists, databases, spreadsheets, and other documentation detailing incidents of legal claims or other allegations requiring compensation for claimants, attorneys, or any other party.

If spreadsheets or similar documents are available in response to this request, please provide all segregable data, including but not limited to:

The nature of the claim or legal matter
The claimant and other parties involved
The relevant case and tracking numbers for court and internal systems
The date the lawsuit was served or litigation commenced
The final disposition or current status of the case, including whether a case is still pending
The amount spent to date as a result of the legal engagement
The amount paid to any parties related to the legal claim, including any city payout and any non-monetary compensation

Hello,

We have received your request of June 27th for, in substance, 10 years' worth of data regarding settlements paid by this agency in regards to "all instances of alleged or actual inappropriate or illegal behavior or actions resulting in compensation or expenditures involving this agency." I am acknowledging receipt of this request pursuant to ORS 192.324(2). At this point, I am uncertain if the City of Beaverton is the custodian of these records. We will review your request and first attempt to determine if the City is the custodian. Should the City be the custodian of these records we will review your request to determine if these records are releasable. If responsive, releasable records are found, there may be a fee associated with production of these records. If that is the case, we will contact you with an estimate prior to beginning work on your request.

We will follow up with you on the status of your request no later than 7/20/20. Please let me know if you have any questions.

Dear Ms. Lipton:

I have conferred with the Risk and Safety Officer about the records you have requested. The City is unsure whether it is the custodian of records requested.

The request asks for records "sufficient to show all instances of alleged or actual inappropriate or illegal behavior or actions resulting in compensation or expenditures involving this agency." It further provides that materials "include" records of all settlements (formal and informal) and payments to which this agency was or is a party from January 1, 2010 to June 27, 2020. The request identifies that additional materials that would be responsive include "reports, lists, databases, spreadsheets, and other documentation dealing incidents of legal claims or other allegations requiring compensation for claimants, attorneys, or any other party."

To clarify, are you requesting all documents from the City's claims files between January 1, 2010, and June 27, 2020, if the City settled a claim in which the claimant alleged "inappropriate" or "illegal behavior?" Please let me know so that I can further confer with the Risk and Safety Officer as to whether the City has the requested records.
