Please be advised that the Aurora Police Department has no records responsive to your request. The department does not maintain a "roster of all department employees with a Genetec user account." To the extent that we interpret this as a request for a list of employees who have Genetec user accounts, the department does not maintain that specific data set for users. The department has not created a record with that information and is not able to run a report. A public body is not obligated to create a new record in response to a FOIA request. Public records are existing records “having been prepared by or for, or having been used by, received by, in the possession of, or under the control of any public body.” 5 ILCS 140/2(c).

A requester is entitled only to records that an agency has "in fact chosen to create and retain.” (Yeager v. Drug Enforcement Administration, 678 F.2d 315, 321 (D.C. Cir. 1982). You have the right to have this denial of your request reviewed by the Public Access Counselor (PAC) at the Office of the Illinois Attorney General. 5 ILCS 140/9.5(a). You can file your Request for Review with the PAC by writing to:
