From: Laura Kiesel

To Whom It May Concern:

Pursuant to the Massachusetts Public Records Law, I hereby request the following records:

I am looking for the total number of "use-of-force" reports filed by or in part by Rick Pedrini over the course of his employment with the Arlington MA Police Department, and access to those reports if they are available.

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by the recommendations of the Massachusetts Supervisor of Public Records. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

I expect the request to be filled in an accessible format, including for screen readers, which provide text-to-speech for persons unable to read print. Files that are not accessible to screen readers include, for example, .pdf image files as well as physical documents.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Sincerely,

Laura Kiesel

From: Arlington Police Department

Good afternoon Laura Kiesel,

Thank you for your public records request.

In this request you seek Use of Force reports filed by or in part by Richard
Pedrini.

The Departmental Use of Force policy requiring a supplemental Use of Force
form report be completed was instituted in 2005. A copy of this policy is
attached hereto.

While there is no public record in particular that would be responsive to
your inquiry, we have performed a review of Use of Force reports filed to
date since implementation of the policy in 2005.

To answer your specific question, Pedrini, as reporting officer, filed 1 Use
of Force report for an incident. Beyond that, it was found that Pedrini was
listed as an involved officer in 2 other incidents where a reporting officer
made a Use of Force report.

These records, or portions thereof, pertain to the arrest of inviduals and
may contain information that is specifically exempted per applicable law,
protected or privileged and therefore subject to withholding or redaction in
order to prevent the unlawful release of sensitive information. As such,
they will require review by Counsel before access in whole or in part is
granted or denied.

Please do not hesitate to let me know if you have any questions.

Sincerely,

Jim
