From: Dave Maass

To Whom It May Concern:

Pursuant to the Georgia Open Records Act, I hereby request the following records:

1) The names of agencies and organizations with which the Agency shares ALPR data;
2) The names of agencies and organizations from which the Agency receives ALPR data;
3) The names of agencies and organizations with which the Agency shares “hot list” information;
4) The names of agencies and organizations from which the Agency receives “hot list” information;

This information is easily available within the Agency’s LEARN system. The simplest way to extract this data is to generate an “Agency Data Sharing Report” PDF file from within LEARN. To do this, a user may simply go to the “Sharing” section of LEARN and select “Output Report.” A CSV/XLS file containing these records would also satisfy this request.

The instructions for extracting this data is described on pages 62-63 of the LEARN Agency Manager Guide, which may be found at this link:

https://www.documentcloud.org/documents/3860685-LEARN-5-1-Agency-Manager-Guide.html

An example of this record may be found at this link:

https://www.documentcloud.org/documents/3936113-Palos-Verdes-Estates-Police-Department-Data.html

A number of other agencies have regularly determined the above information constitutes a public record and have provided an “Agency Data Sharing Report.” These agencies include:

Anaheim Police Department, Antioch Police Department, Bakersfield Police Department Chino Police Department, Clovis Police Department, Elk Grove Police Department, Fontana Police Department, Fountain Valley Police Department, Glendora Police Department, Hawthorne Police Department, Irvine Police Department, Livermore Police Department, Lodi Police Department, Long Beach Police Department, Montebello Police Department, Orange Police Department, Palos Verdes Estates Police Department, Red Bluff Police Department ,Sacramento Police Department, San Bernardino Police Department, San Diego Police Department, San Rafael Police Department, San Ramon Police Department, Simi Valley Police Department, and the Tulare Police Department.

We further request the following records

The aggregate number of “detections” (i.e. license plate scans and associated data) collected during 2016.
The aggregate number of detections collected during 2017.
The aggregate number of “hits” (i.e. times that a plate on a hotlist was detected) during 2016.
The aggregate number of “hits” during 2017.

This information is easily available within the Agency’s LEARN system. The simplest way to extract this data is to generate a “Dashboard Hit Ratio Report” PDF file from within LEARN. We would prefer the data for each year to be provided separately.

An example of this document may be found at: https://www.documentcloud.org/documents/3870802-Sacramento-PD-Hit-Ratio-Rpt-010112-051917-Redacted.html

The instructions for extracting this data is described on pages 78-79 of the LEARN Agency Manager Guide, which may be found at this link:
https://www.documentcloud.org/documents/3860685-LEARN-5-1-Agency-Manager-Guide.html

The following agencies have regularly determined the above information constitutes a public record and have provided an “Dashboard Hit Ratio Report.” These agencies include:

Anaheim Police Department; Bakersfield Police Department; Chino Police Department; Clovis Police Department; Elk Grove Police Department; Fontana Police Department; Irvine Police Department; La Habra Police Department; Laguna Beach Police Department; Lodi Police Department; Sacramento Police Department; San Diego Police Department; San Ramon Police Department; and the Red Bluff Police Department.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 3 business days, as the statute requires.

Sincerely,

Dave Maass

From: Gwinnett County Police Department

I have forwarded this request to the Gwinnett County Sheriff’s Office. The Gwinnett County Police Department is a user on their system, but the Sheriff’s Office maintains the data.

The below email was forwarded to me from the Gwinnett County Police Department. The Gwinnett County Sheriff's Office manages the LPR system. However, we do not use Vigilant cameras. We do not have a report designed to pull out the information requested. It will probably take 10-14 working days. There will be a cost of approximately $200.00. Please advise if you would like for me to proceed.

Thank you for the quick response.

Just to clarify, records indicate Gwinnett County Police Department has it's own Vigilant Solutions LEARN account that is separate from the LPR system run by the sheriff's department. This means that the police should be able to provide data for items 1-4 through the data sharing report, but the hit/detection may not be relevant.

Could you please double check with the police department regarding this matter?

NOTE: Email is provided to employees for the administrative needs of the county. Email correspondence to / from a county email account is considered public information and subject to release under Georgia laws or pursuant to subpoena.

Pursuant to the Georgia Open Records Act, I hereby request the following records:

1) The names of agencies and organizations with which the Agency shares ALPR data: The Vigilant Tier our agency currently has does not share our reads with any other law enforcement agencies. Our subscription only allows limited access to other law enforcement reads.

2) The names of agencies and organizations from which the Agency receives ALPR data: The Gwinnett County Police Department receives information from the law enforcement agencies that contribute to the LEARN system, which is operated by Vigilant Solutions. Each individual agency makes the decision to share their particular reads by sending a request to the respective Agency Manager.

3) The names of agencies and organizations with which the Agency shares "hot list" information: It should be noted Gwinnett County strictly complies with the laws and regulations regarding the dissemination of information as it relates to NCIC/GCIC rules. Hot lists are automatically uploaded twice a day through GCIC/NCIC at the discretion of the Georgia Bureau of Investigations (GBI) who is responsible for entering such data. This information in turn is available to authorized personnel who have been certified in Security & Integrity Training. (For further information regarding "hotlist(s)" protocols please contact the Georgia Bureau of Investigations).

4) The names of agencies and organizations from which the Agency receives "hot list" information: Please refer to question #3 for response

The aggregate number of "detections" (i.e. license plate scans and associated data) collected during 2016: This particular question as well as the three (3) that follow does not pertain to the Gwinnett County Police Department. We do not possess Vigilant supported license plate reading cameras. Therefore, we do not receive detections or contribute with conducting scans that would be placed on the LEARN system.

The aggregate number of detections collected during 2017: Refer to question #5 for reply. Not applicable.

The aggregate number of "hits" (i.e. times that a plate on a hotlist was detected) during 2016: Refer to question #5 for reply. Not applicable.

The aggregate number of "hits" during 2017: Refer to question #5 for reply. Not applicable.

Sincerely,

Dave Maass

Hello,

Please provide the names of the agencies from which Gwinett County receives ALPR data. This information is contained in your Vigilant account and other Georgia agencies have had little difficulty providing this information.

Thank you,

Dave

From: Gwinnett County Police Department

I believe you received a different reply from our Records Unit. After some research, we agree that this is subject to an Open Records Act request under Georgia Law. The document containing the items requested is attached.

From: Dave Maass

Hello, thanks for the record. Do you happen to have the detection/hit information as well?

From: Gwinnett County Police Department

We do not because we don’t have LPR cameras that feed the Vigilant system. All we have is access to the Vigilant system for when detectives need to check a license plate in reference to an investigation. That might be of note for #1 and #3 in your original request as well; although our system is set up to share information with the list of agencies in the response, we do not actually send any data.
