This is a request under the Freedom of Information Act. I hereby request the following records:

All records referencing the five oldest FOIA and Privacy Act requests which are still being processed that contain remarks, comments, notes, explanations, etc. made by your personnel or contractors about the processing of these requests (and appeals, if appropriate), the invocation of exemptions, or related matters. This is to include any analysts' notes made during the processing of the requests, any standard worksheets completed by the analysts, any justifications for exemption invocations or other supporting documentation provided to the Appeals Authority, and any correspondence referencing the requests, including tasking orders, emails, and coordination documentation. However, any records previously released to the original requesters in unredacted form may be excluded from this request. Additionally, please provide the initial request letters for the 5 oldest open FOIA/PA requests.

When processing this request, please note that the D.C. Circuit has previously held that agencies have a duty to construe the subject material of FOIA requests liberally to ensure responsive records are not overlooked. See Nation Magazine, Washington Bureau v. U.S. Customs Service, 71 F.3d 885, 890 (D.C. Cir. 1995). I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We assigned your request United States Special Operations Command
(USSOCOM) FOIA control number 2011-034 and it will be processed in
accordance with procedural requirements promulgated in DoD Manual
5400.7-R, which is available on the internet at:
http://www.defenselink.mil/pubs/foi/. Please refer to this number
should you have any questions concerning your request.

While you have requested a fee waiver, we are unable to make a decision
on a fee waiver until the search for documents has been completed. We
do not know what records, if any, we hold or what information in those
records will be released. In addition, we must examine the contribution
the information will make to the understanding of the subject by the
general public that is likely to result from disclosure. We must
examine the significance or impact of disclosure in contributing
previously unknown facts and thereby enhancing public knowledge. If the
information that is released will basically duplicate what is already
known by the general public, then the information would not
significantly inform the public. If we find the records are denied in
full, then there would be no information to contribute to the public.

We have placed you in the "All Others" category for fee purposes. This
means you are entitled to two hours of search, all review costs, and the
first 100 pages at no cost. Depending on the size of the document, we
may provide the final response on compact disk.

In the interim, you will need to provide a fee agreement.

The USSOCOM FOIA Office has a substantial number of over 150 pending
cases; therefore, we process requests in a multi-track processing system
based on the date of receipt and the amount of work and time involved in
processing each request. We placed your request in our complex
processing queue and will process it consistent with the order in which
it was received. The actual processing time will likely exceed the 20
day statutory time period as there may be unusual circumstances which
impact on our ability to quickly process your request.

You already have an open appeal on requesting your status as news media with the Office of Freedom of Information; however, you are welcome to contact our Public Liaison at 703-696-4703. Note you still remain in the "All Others" category.

The FOIA sets three standards that must be met for a requester to qualify as a representative of the news media:

1. The requester must be a person or entity that gathers information of potential interest (news) to a segment of the public. The FOIA defines "news" as information that is about current events or that would be of current interest to the public. Representatives of the news media are organized to seek out and gathered by public interest, not information that interests the requester.

2. The requester must use its editorial skills to turn the "raw materials" into "distinct work." You did not describe how you plan to use your editorial skills to turn these documents (if any) into distinct work. Distinct work does not mean posting documents received from an agency on a website (your website is simply a depository for government documents and not distinct work).

3. The requester must distribute that work to an audience. You have not provided how you would provide how this information would be disseminated to the general public.

Mr. Hogan,

I am having trouble dealing with USSOCOM concerning the 5 oldest pending FOIA requests that you previously contacted me about. USSOCOM denied my request to be treated as news media for the purpose of billing and is requesting a blanket fee authorization (without providing me an estimate). They have threatened to close the case today if I do not provide that authorization.

I provided the following informaiton concerning my request for news media category billing:

I ask that you intervene in this case, ensuring it remains open and either having it processed according to the news media fee category or allowing for a proper appeal to be submitted on the matter without closing the case.

I have copied Corinna Zarek from the Office of Government Information Services, as I have asked her to look into the inconsistent application of the news media fee category in various agencies, which I will expand to include USSOCOM if we cannot resolve the issue without her mediation.

I am contacting you for assistance with a recent request I made under the Freedom of Information Act (FOIA).

USSOCOM has denied me access to the news media fee category. They have done this based on the fact that another DOD compent denied me access to the news media fee category. Furthermore, USSOCOM has denied me the ability to appeal based on the fact that I had a pending appeal in the DOD concenring fee categories. Their last email to me threatened to close the case unless I agreed to be billed as "all other." I responded, but have not heard back from them since.

I will have to review the case in depth as there have been many hands before me working this request. This pertains to your Freedom of Information Act (FOIA) request submitted to U.S. Special Operations Command (USSOCOM) for documents pertaining to the 5 oldest pending FOIA cases, which was assigned USSOCOM FOIA 2011-034, and our final response to your inquiry.
