To Whom It May Concern:

Pursuant to the Freedom of Information Act, I hereby request the following records:

Public reports show that government entities including the Department of Homeland Security, the Internal Revenue Service, the General Services Administration, U.S. Census Bureau and the Centers for Medicare & Medicaid Services use Microsoft's Azure cloud service. In June, Microsoft announced it would incorporate OpenAI to its government services (https://azure.microsoft.com/en-us/blog/unlock-new-insights-with-azure-openai-service-for-government/).

1) All instructional materials, presentation material (including recorded video and audio, PowerPoint files, prepared remarks, and slide formats), and other guidance about the usage of Microsoft Azure and Microsoft Azure's OpenAI service.

2) A copy of any use policies, standard operating procedures, data retention policies, legal opinions, warrants, non-disclosure agreements, liability waivers, insurance agreements, , Letters of interest, usage policies, or informal agreements between the department of defense and Microsoft regarding Microsoft Azure and its OpenAI services. Please include any of the above between government agencies and Microsoft.

3) A copy of any funding opportunity announcements, grant applications and grantor status/ progress reports, reports to legislative bodies, annual reports that mention Microsoft's OpenAI service, as well as audit records, including but not limited to security audits of the software, misuse reports, and reports to oversight bodies.

4) Any digital communications including but not limited to emails and text messages as well as documents (including but not limited to PDF, word processing, excel and slide documents) that mention Microsoft Azure's OpenAI service (please including all attachments) from

5) Any case reports in which Microsoft's OpenAI service was disconnected, shutdown or changed in some way due to privacy or security concerns.

6) Any digital communications (including but not limited to emails and text messages) with Microsoft (@microsoft.com) or their representatives.

To help limit the extent of the responsive documents, please limit search from June 6, 2023 through the time this request is processed. Please delivery these documents on a rolling basis as responsive documents are found.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

I have attached our final response to your FOIA request, case 2024-03416. Though we would not be able to process certain portions of your request, we had our Information Technology office (IT) search for items 1. The plan was then to use the findings to help locate the other items. IT responded that the IRS does not use the AI software named in your request. Based on this we are providing a final response.
