Pursuant to the Freedom of Information Act, I hereby request the following records:
- A re-processed copy of the files released to New York Times following a FOIA lawsuit (https://foiaproject.org/2020/02/06/the-new-york-times-company-v-federal-bureau-of-prisons-and-45-other-new-foia-lawsuits-plus-case-descriptions/, plus copy of records attached)
- Any additional unprocessed records there were not previously disclosed due to exemption
The previously released files make prominent use of the (b)(7)(a) exemption, and as per the DOJ's own FOIA guidance:
"It is beyond question that Exemption 7(A) is temporal in nature and is not intended to “endlessly protect material simply because it [is] in an investigatory file.” Thus, as a general rule, Exemption 7(A) may be invoked so long as the law enforcement proceeding involved remains pending or so long as an enforcement proceeding is fairly regarded as prospective or as preventative."
I am making this request in my capacity as a journalist who has written extensively about government transparency. As such, I am not requesting a fee waiver, but I am requesting I be placed in the media requester category.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 20 business days, as the statute requires.

I am appealing your 8/10 response to my FOIA request. I did not accuse your agency of using "any new or additional exemptions to withhold information," but rather to determine if the sections currently withheld under b(7)(a) still merit withholding under the DOJ's b(7)(a) guidance. If that is the case, please put so in writing, otherwise please re-process the records as requested. Thank you.
