Pursuant to the South Dakota Open Records Law, I hereby request the following records:

Any and all 911 dispatch audio, transcripts, and radio transmissions between officers, related to the investigation of the officer involved shooting that occurred around 10:30PM, on 3/31/22, resulting in the death of Cody Wade Kelly.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

Good morning Ms. Hart,

We have received your request for records regarding Jacob Michael James, Cody Wade Kelley and Marvin Moran Jr.

We had previously responded to your request regarding Jacob Michael James on June 13th, 2023. Attached is an additional copy of that response.

Also attached is a response letter regarding your request for information on Cody Wade Kelley.

The incident involving Marvin Moran took place in Rapid City and did not involve the Sioux Falls Police Department. As such, we have no responsive records.
