RE: Public Records Request of February 16, 2022, Reference # S000360-021622

Dear Mr. Sinyangwe, The Sheriff's Department is in receipt of your communication, dated and received February 16, 2022, seeking records pursuant to the California Public Records Act (CPRA).  Specifically, you request "A spreadsheet containing all data reported to the California Department of Justice from 2018-21 pursuant to the Racial and Identity Profiling Act, including all columns of information/variables as well as all location and narrative columns reported under this program." July 1, 2018 – June 30, 2021 To date, the Sheriff's Department has provided the Cal-DOJ with RIPA data from July 1, 2018 through June 30, 2021. The Sheriff's Department is providing this data, free of charge, because it was produced for the Cal-DOJ. Pursuant to RIPA, the data reported is available to the public, except for the badge number or other unique identifying information of the peace officer involved. Additionally, law enforcement agencies shall not report the personal identifying information of persons stopped, searched, or subjected to property seizure. Law enforcement agencies are solely responsive to ensure that personally identifiable information of the person stopped, and information exempt from disclosure pursuant to Government Code section 12525.5 is not released. 11 CCR § 999.228. The reporting agency "may review the stop data to correct errors before submitting the stop data to the Department." 11 CCR § 999.227. Thus, pursuant to Government Code section 6254(k), incorporating Government Code section 12525.5(d), and Code of Regulations sections 999.224 through 99.229, the Sheriff's Department reviewed the stop data and corrected errors, and redacted the following information: 1. Officer's badge number and/or unique identifying number 2. Officer's years of experience 3. Officer's type of assignment 4. Personal identifying information of the person stopped Pursuant to the limitations above, the Sheriff's Department is providing the requested data for stops made between July 1, 2018, and June 30, 2021.  The Sheriff's Department is providing you with the JSON data that was submitted to and accepted by the Cal-DOJ.  Each row contains all of the information related to a specific RIPA stop.  Responsive records are available in the Records Request System.  Please log in to your online account and retrieve the records. (https://u8387778.ct.sendgrid.net/ls/click?upn=6HtRfOYLt5fXvpttM-2FU1HWml5iZPx8ayxNWpXgGXQtbHmNW5Tg-2BB0d-2FjqMi5e5KOFHOb4sE5LQAuL33V7BeaaiLrfmA35x5iD5IwX7Aa-2Bhj7RLSd2-2FDuikaofcdDQpcp1FWL_Uv8wrCQ3Uh0tYD-2BAkMsa5hjsGTiQxNc5wernVN-2BU2elqtt4ZcjbLwDu4RqvTfZa9lbQTCMNMI-2FO3WJR5JB0QLdYoyRp8UVkGfeqJITdR6qkaHMD2Qssvnx1c9LVpwWQ5pOfR9-2F3quC97EM-2B-2BHeo-2FE3WhFlkt1jXSKbKkeLI-2BVfrLSK2yGu3M4ETqtCaUEgpsBoMMAF-2FVA-2FfKtht-2BH-2FGa8NDFrHE11v8h6e72JhZHEF0-3D) July 1, 2021 – December 31, 2021 The RIPA statutes require the Sheriff's Department to provide RIPA data to the Cal-DOJ by April 1 st of each year. Due to the high volume of data, the Sheriff's Department extracts, produces, and provides RIPA data to the Cal-DOJ two times per year. The record is produced only at these regularly scheduled intervals by October 31 st and April 1 st The Sheriff's Department is in the process of extracting and producing the RIPA data for July 1, 2021 through December 31, 2021 and providing it to the Cal-DOJ.  Once the data has been produced for and accepted by the Cal-DOJ, the Sheriff's Department will provide you with the record, free of charge.
