Pursuant to the Oregon Public Records Law, I hereby request the following documents:

(1) All data generated and retained through use of Automatic License Plate Readers (ALPR) by Portland Police Bureau (PPB), specifically: License plate, date, GPS location, unit number generating the data, disposition and result of check of plate. Deliver complete dataset generated and provide in electronic form, spreadsheet or database.

(2) All policies, guidelines, manuals and/or instructions on department use of ALPR.

(3) Make and model of ALPRs in use by PPB.

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

RESPONSE:

The data you requested is exempt from disclosure. Pursuant to Police Bureau policy, the ALPR database may only be accessed when there is probable cause during the course of an already-ongoing criminal investigation. The Portland Police Bureau has intentionally created this policy to ensure no City employee can query the database to search for crime, or non-criminal investigatory purposes, but only to support an ongoing criminal investigation begun in response to a report of crime. This strict control over access means the data is not seen by any person unless it is pertinent to a criminal investigation.
The policy aligns the City of Portland with the Oregon limitations on police investigations of non-criminal relationships and associations.

Per ORS 181.575, no law enforcement agency may collect or maintain information about political, religious, or social views, associations or activities of any individual, group, association, organization, corporation, business, or partnership unless such information directly relates to an investigation of criminal activities, and there are reasonable grounds to suspect the subject of the information is or may be involved in criminal conduct. Accessing the database for your public records request would violate the Police Bureau policy. Your request for all data has been denied.
