Information on all hate crimes occuring in the city of jurisdiction from January 1, 2010 to December 31, 2020. The information should include (although not be restricted to) the following: date-of-occurrence (YYYY-MM-DD), time-of-occurrence (HH:MM), description of crime committed, location information at the finest geographic level available (street address or block), beat, district, weapon used, bias motivation (e.g., Anti-Black/Anti-Gay/Anti-Transgender), number of suspect(s), number of victim(s), injuries incurred, suspect(s) race, victim(s) race, victim(s) sex, suspect(s) sex,, victim(s) age, suspect(s) age.

Please provide me with these public records in a machine-readable ASCII format, such as a CSV, SQL, TXT, or similar raw file. CSV or SQL files are preferred when available. Please email the responsive records to my email address: michaeltopper@ucsb.edu.

If email transmission is not feasible, I agree to prepay the actual cost of the storage medium on which the responsive records are transmitted, any postage costs incurred.

The City responds as follows: The City has located records responsive to your request and has determined that some of the information is exempt from disclosure under the Public Records Act (Gov. Code, § 6250 et. seq.) for the following reasons:

* The City does not maintain its records in a manner that would compile a document that would respond to portions of the requested topics ( Haynie v. Superior Court (2001) 26 Cal.4th 1061.) The City would have to pull all the identified reports to obtain the following requested topics: "weapon used"; "bias motivation"; "number of suspect(s)"; "number of victim(s)"; "injuries incurred"; "suspect(s) race"; "victim(s) race"; "victim(s) sex"; "suspect(s) sex"; "victim(s) age"; and "suspect(s) age".
* The request seeks records not required to be disclosed under the investigatory records exemption (Gov. Code, § 6254(f); Williams v. Superior Court (1993) 5 Cal.4th 337; Haynie v. Superior Court (2001) 26 Cal.4th 1061). The request seeks records that contain information protected by a constitutional right to privacy (Gov. Code, § 6254(k); U.S. Const., 14th Amend.; Cal. Const. Art. I, § 1).
The City's system only pulls incidents that include "hate crime" within the initial case report written by the Fresno Police Department. The provided document may not be an accurate reflection of all "hate crimes" occurring within the City during the requested time frame. The Fresno Police Department does not have a call classification for "hate crime". The City has redacted exempt information and/or records.
