Pursuant to Virginia Freedom of Information Act, I hereby request the following records:

Copies of all reports, lists, or databases detailing the number and status of lawsuits brought against the the Fairfax County Police Department and the Fairfax County Sheriff Department since 2006. This should include requests for, or documentation of, funds used to cover settlement agreements, court costs, or other expenses related to lawsuits.

This request should be construed to include any document submitted to, compiled by, or in any way maintained by the law department that lists lawsuits brought against the police department between 2006-2013. If a document exists that contains the requested information for some, but not all of the above mentioned years, please include that/those document(s).

The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, and is not being made for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

I am responding on behalf of Fairfax County's Risk Management Division to the Freedom of Information Act (FOIA) request sent on March 4, 2015, for "[c]opies of all reports, lists, or databases detailing the number and status of lawsuits brought against the Fairfax County Police Department and the Sheriff Department since 2006. This should include requests for, or documentation of, funds used to cover settlement agreements, court costs or other expenses related to lawsuits." Because the County was closed on March 5, 2015, the five business days to respond did not start to run until March 6, 2015.

Please be advised that Risk Management does not have records for the Sheriff's Office. Such records may be obtainable from the Virginia Department of the Treasury, Division of Risk Management, 101 North 14th Street, Richmond, VA 23219.

You requested to be informed of the total charges in advance of fulfilling your request. I have preliminarily determined that the cost of providing you with a report such as you have requested is $ 42.50. This cost is based upon an estimated three hours for an administrative assistant ($17.50 x 3) to extract the information pertaining to the Police Department from our database. Because this is merely an estimated cost, it is subject to change. If you are requesting additional documentation other than this report, please let me know what specific records you are requesting as FOIA requires that requests be made with reasonable specificity. Va. Code Ann. § 2.2-3704(A). This estimate does not include any charges for any additional documentation you may request. Should you wish to proceed with your VFOIA request, please let me know.
