Pursuant to the Illinois Freedom of Information Act., I hereby request the following records:

a copy of all declarations received from law enforcement agencies between 12/1/2023 and the date this request is processed that expressly affirm that ALPR information obtained shall not be used in a manner that violates subsection (b) of 625 ILCS 5/2-130.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Hello, we are not asking for police reports related to an arrest or incident.

I am writing in response to the closure of my FOIA request #24-736, wherein I sought a copy of all declarations received from law enforcement agencies between 12/1/2023 and the date the request is processed, affirming that ALPR (Automatic License Plate Reader) information obtained shall not be used in a manner that violates subsection (b) of 625 ILCS 5/2-130.

The request was denied and closed with this message:

“Denied - Police Investigation
The request for police reports related to an arrest or incident is denied because the disclosure would interfere with an active investigation, no charges have been filed and accordingly records related to the arrrest or incident are exempt from disclosure under Section 7(1)(d)(iv) of the Illinois FOIA law.”

To clarify, my request was not aimed at obtaining police reports related to any arrest or incident, nor was it seeking information that could interfere with an active investigation. Instead, my inquiry was focused solely on obtaining declarations of compliance with specific statutory requirements governing the use of ALPR technology, which are administrative in nature.

The documents in question are purely administrative declarations of compliance with state law, it seems they would not fall under the exemption for records that could compromise an ongoing investigation.

I look forward to your response by Monday April 8th. Otherwise we will send this request to the Illinois Attorney General Public Access Counselor for review .
