If the records requested would further incriminate an agency can the agency legally refuse to respond? Would not a refusal to respond, in order to conceal records of criminal activity, amount to an additional criminal act by the agency?

Chris, hello- Yes, but refusal to respond to a records request is in most states a fairly minor infraction. Without a strong records watchdog, there’s little incentive for an agency to comply. Best, J.Pat
