Are tort claims, documents submitted with the claims, or their settlement agreements exempt from FOIA? If so, under what exemption.
Are there any special strings attached when it comes to getting these documents, such as wait periods?
I don’t believe so. I think they might be exempt by statute if the documents are related to an on-going lawsuit, though, but that’s just speculation.
