Pursuant to the Ohio Open Records Law, I hereby request the following records:

• All text messages exchanged between Mayor John McNally and any representative of Corrections Corporation of America. It was reported that Mayor McNally recently received at least one text message from a CCA employee (http://businessjournaldaily.com/company-news/cca-wants-know-why-it-lost-inmate-contract-2014-12-30).

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I would request your response within ten (10) business days.

Dear Mr. Lipton:

A further records request was made by you wanting to obtain “All text messages exchanged between Mayor John McNally and any representative of Corrections Corporation of America.” You further state in your request that it was reported that Mayor McNally recently received at least one text message from a CCA employee.

Please be advised that I have spoken to the Mayor about your request, and he does not have any text messages to or from employees of CCA saved. He does recall that a text message exchange took place between himself and representatives from CCA but there was no substance to the text. The text message that he recalls was simply a superfluous text suggesting that a meeting take place or he’d “like to get together to talk.”

If you have knowledge of any specifics of a text message with any particular individual from CCA, please provide me with same and I will let the Mayor know. Hopefully this will help to refresh his recollection.

Hello Mr. Donofrio,

Thank you for your message, and I apologize for the confusion caused by the follow ups to this request. I cannot provide any specific information regarding the recipient(s) of Mayor McNally's text message exchange. However, it was reported that Mayor McNally initially received notice via text message that Northeast Ohio Correctional Center would be losing its contract; this would have taken place in the last few days of December 2014, I believe. I don't wish to request all of the text messages received during that month, and I must assume that Mayor McNally has some familiarity with which contact people at CCA would have let him know of the change, but I can submit another request for a broader range of text messages within the appropriate time frame, if that would be simpler. Please let me know how else I might clarify my search.
