I wanted to follow up on the following Wisconsin Open Records Act request, copied below, and originally submitted on April 8, 2020. Please let me know when I can expect to receive a response.

Thanks for your help, and let me know if further clarification is needed.

From: Assembly Speaker Robin Vos (wi)

Dear Mr. Tidmarsh:

This email confirms receipt of your public records request on 4/8/2020. It is attached.

Wis. Stat. 19.35(3)(f) allows our office to require prepayment of fees related to an open records search if the cost will be greater than $5. Wisconsin courts have noted that this statute's purpose "is clearly intended to protect an authority from squandering staff time, supplies and equipment usage for a substantial copying project that a requester might later disavow." (State Ex Rel. Hill v. Zimmerman, 196 Wis.2d 419 (1995)). In order to not squander future "staff time, supplies, and equipment usage" we ask that you prepay for this request.

We estimate that the cost for this request will be approximately $150.

Please remit this amount to the Assembly Chief Clerk's Office. Upon prepayment your request will be fully processed pursuant to Wisconsin law and the procedures of the Wisconsin State Assembly, and a response will be prepared.

If you have any questions regarding your request, please contact our office.

Sincerely,

Steve Fawcett

Dear Mr. Tidmarsh:

According to our records you submitted 4 open records requests. We require prepayment for large requests. You submitted prepayment for 2 requests which have been filled. The other two outstanding requests will be processed when the Chief Clerk’s Office receives prepayment for those requests.

Please let me know if you have any other questions.

From: Christopher Tidmarsh

Hello,

I'm really sorry you kept getting emails from me asking for the documents even after you turned them over to me. The service I use to send records requests, Muckrock.com, sends automated emails asking for the status of records requests, and I must have forgotten to mark this records request as completed.

I've now marked the request as completed, so you shouldn't receive any more emails from me.

But if for some reason you do continue to receive them, for this request or any others, then please let me know and I'll fix it.

In any case, thank you so much for turning over this records request to me. I really appreciate it!

Sincerely,
Christopher Tidmarsh

From: Assembly Speaker Robin Vos (wi)

Got it.
Thanks,
Steve
