Pursuant to Wisconsin's Open Records act, I hereby request the following records:

-The current memorandum of agreement (MOA) or memorandum of understanding (MOU) with the Defense Logistics Agency, Disposition Services regarding the 1033 equipment surplus program administered by the DLA Law Enforcement Support Office

-The annual inventory form required to be completed by the state coordinator of the 1033 program

According to the DLA FAQ page regarding the 1033 program, DEM Department is the agency in charge of coordinating the 1033 program for Wisconsin. See http://www.dispositionservices.dla.mil/leso/Pages/StateCoordinatorList.aspx

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

You are advised that there is no official annual inventory form required to be completed by the Wisconsin state coordinator of the 1033 program. As such, no record exists.

Thank you for sending the MOA. Regarding the inventory, more than 20 states now have sent an inventory spreadsheet of nearly identical format. It is my impression that 1033 state coordinators compile or at least download and review such a spreadsheet from the DLA website as part of conducting the annual inventory review, which is cited in the MOA you've provided as part of the state coordinator's obligations.

I've attached a few examples of such spreadsheets as released by state coordinators.

Please let me know if DEM has a corresponding spreadsheet for Wisconsin.

The Wisconsin 1033 Program does maintain a listing of equipment provided to law enforcement agencies. Your request for an "annual inventory form" did not match the type of records we currently maintain for the 1033 Surplus Equipment program.

I will need more specificity for your request. What specific time period are you looking for?

Apologies for any confusion. This is by no means an open-ended request -- I am requesting the most current version of both documents.

For the MOA, most other states have had an MOA signed within the past two years, and many had an additional addendum signed in 2014 with the Defense Logistics Agency. This is a request for the current MOA between the state of Wisconsin and the federal government pertaining to the 1033 program.

For the inventory spreadsheet, I am similarly requesting the current inventory spreadsheet -- the 1033 current inventory includes all "controlled" items (these include such equipment categories as weapons, aircraft, night vision and other tactical items) dispensed back to the start of the program, as well as non-controlled items for the past year. Again, these time frame details have been consistent across all 27 state coordinators that have provided documents in response to an identical request. If the above is not sufficient detail, please consider this to be a request for all such inventory spreadsheets for 2014.

Pursuant to your Wisconsin Open records request, attached please find an Excel spreadsheet detailing military equipment provided to Wisconsin law enforcement agencies by the Department of Defense under the 1033 program from July 1, 2004 to present. This information includes the name of the law enforcement agency, type of equipment received, national supply numbers (NSN), costs/value, and shipping dates.

You are also advised that the records currently maintained by this agency only go back to July 1, 2004. As such the spreadsheet covers the period of July 1, 2004 through present.

I will note that you were provide a copy of the current memorandum of agreement (MOA) between the State of Wisconsin and the Defense Logistics Agency, Disposition Services regarding the 1033 equipment surplus program in an email dated August 28, 2014.
