Pursuant to the New York Freedom of Information Law, I hereby request the following records:
All records mentioning or pertaining to the late Dr. Harold Nelson Bornstein, private physician. An attached obituary shall serve as proof Bornstein has passed away in 2021; as such, privacy interests are diminished. Of particular interest is any documentation of investigation or complaint that would normally be reviewed for investigation, where Bornstein is author of said complaint, the subject of the complaint, as a witness or as consultant.
The public interest in any records held by the agency is overwhelming, as the subject was personal physician to the 45th President of the United States of America prior to his election, and has been a public figure who is the subject of several news articles.
To assist in the identification of records, please note the following identifiers:
First five digits of Social Security Number 078-38;
DOB: March 3, 1947;
POB: New York, NY;
Residence: Scarsdale, NY;
Physician License No: 127270;
Date of Licensure : 07/01/1976.
The requested documents will be made available to the general public, and this request is not being made for commercial purposes.
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We apologize for the delay in acknowledging receipt of your request pursuant to the Freedom of Information Law (FOIL) (Public Officer's Law, Article 6). Please be advised that due to the current events surrounding the COVID-19 outbreak, and the Governor's Executive Orders, including the tolling of time limits under FOIL, our office function has changed for the time being. In light of events relating to COVID, the turnaround time for responding to FOIL requests is taking longer than normal. This is in response to your request pursuant to the Freedom of Information Law.
Please be advised that section 89(3) of the Public Officers Law requires that requests for records be "reasonably described". Your request for "[a]ll records mentioning or pertaining to the late Dr. Harold Nelson Bornstein," is overly broad and fails to reasonably describe the records sought. However, we have interpreted your request to mean any complaint or investigation against Dr. Harold Bornstein, any or criminal conviction of Dr. Bornstein. Our search locates no records of a criminal conviction or complaint against, or investigation of Dr. Bornstein.
