Pursuant to the West Virginia Freedom of Information Act and the West Virginia Open Governmental Proceedings Act, I hereby request the following records:

• The current records retention schedule for the West Virginia Division of Corrections

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This is in response to your Freedom of Information Request, dated January 27, 2015. Specifically, you have requested: "The current records retention schedule for the West Virginia Division of Corrections."

The West Virginia Division of Corrections' Policy Directives are available through the Secretary of State's office, or may be inspected at this office. Policy Directive #105.08, "Records Management Program," is being attached to this email. Included in the directive is the "Master Records Retention and Destruction Schedule" used by the WVDOC.

To the extent you consider any part of this response as a denial, the responsibility of this Agency to respond to your initial request is at an end, and you may institute an action for declaratory and/or injunctive relief in the Circuit Court of the county in which you assert the records are kept, subject to all jurisdictional and procedural prerequisites, which are specifically not waived.
