Pursuant to the West Virginia Freedom of Information Act and the West Virginia Open Governmental Proceedings Act, I hereby request the following records:

Wildlife conservation plans for two species of crayfish, approved by U.S. Fish and Wildlife Service in conjunction with the State of West Virginia's Department of Environmental Protection, issued as part of the permit for the Berwind Mine.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Requestor seeks the above listed records for noncommercial use as a representative of the news media. I work for the Climate Investigations Center, which qualifies as a news media organization under the definition provided by Congress in the OPEN Government Act because it “gathers information of potential interest to a large segment of the public, and uses its editorial skills to turn the raw materials into a distinct work, and distributes that work to an audience.”
In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Our agency, the WV Department of Environmental Protection is receiving what we believe to be an automated fax communication from your business every Monday morning at approximately 4:00 a.m. The fax request is from a Jesse Coleman who initially filed a Freedom of Information Request through your fax system.

Mr. Coleman's original FOIA request came into our agency from your fax system back in September 2017. We provided Mr. Coleman with the information he requested, however, the fax requests kept coming.
