Pursuant to the Maine Freedom of Access Act ("FOAA"), I hereby request the following records:
A copy of the police report generated by the Waterville Police Department concerning allegations against a man named Don Reiter, who served as the principal of Waterville Senior High School before being placed on administrative leave in September 2015. The existence of the police report has been widely reported by news media:

I also request that, if appropriate, fees be waived as we believe this request is in the public interest, as suggested but not stipulated by 1 M.R.S.A. § 408(6). The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.
In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 10 business days, as the statute requires.

I have reviewed your letter regarding my request for Waterville Police Department’s report concerning unspecified allegations against Don Reiter. If I understand your reply correctly, you are denying the release of the document because the District Attorney’s office has not yet completed its review of the report.
I have two questions:
1. Which statute of the Maine Freedom of Access Act prevents the release of the record for the reason you stated?
2. Do you know when the District Attorney is likely to complete its review?

1. Maine State Statute Title 16, Chapter 9, Section 804 of the
Intelligence and Investigative Record Information Act prevents the
release of the requested record.
2. I do not know when the District Attorney is likely to complete its
review.
