In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Ms. Bodnar,

The record you provided on February 12, 2021, in response to my request of February 4, 2021, seems to be a report of records requests, not the requests themselves. I am amenable to receiving this record instead of those which I requested if you can provide certain related information. Can you confirm that each of the requests for which a record exists in the report was delivered via email from the requester directly to Robert Page of Washington Employment Security Department (i.e., not through your records management system or "portal," not via email to a centralized alias that is monitored by Mr. Page and/or other people, etc.)? From what was the report generated, and could it be generated with additional information, such as outcome or current disposition of request?

FYI, I am researching the existence of requests that were delivered directly to Mr. Page via email. I understand that he has on occasion refused to process such requests, instead directing the requester to submit the request a second time in a different manner, which I believe to be a violation of the Public Records Act. The report that you provided in lieu of the requests for which I placed my request strongly indicate that Mr. Page regularly receives and processes requests that are sent directly to him, thus suggesting that he is inconsistent in his violation of the PRA in the aforementioned manner.

I received your communication of March 17, 2021. In it, you refer to a records request purportedly placed by me yesterday, on March 16, 2021. Please understand that my e-mail to you on March 16, 2021, was not itself a request for records, but was a followup to my request of February 4, 2021, which you assigned identifier PRR-2021-0019.

You have yet to provide the records I requested on February 4. Instead, you apparently generated a report, created images of the text of that report, combined those images into a PDF, and sent it to me on February 12, 2021. I wrote yesterday to discuss the possibility of revising my request such that the record you provided is responsive to it. I believe we can avoid additional work for both of us.

Please do not treat my followup communication as a new request. I have placed a single request with your agency this year, and it has now been almost six weeks since you received that request.

The report was provided to you as a means to respond to your request quickly. Unfortunately, it appears that the report as provided was not responsive to your request and for that I apologize. And, it appears even if modified, the report will not show which requests were received directly by Mr. Page, rather than to the general public records request email address.

For tracking purposes, rather than reopening the old request, a new request number was assigned. The creation of the new request number was due to the amount of time from when the request was closed and your subsequent email.

I hope the foregoing is helpful and I apologize for any confusion. We will commence reviewing each and every request to provide you with a copy of those requests received directly by Mr. Page, if any. I estimate we should have a batch available on or before April 9, 2021. If this time estimate changes I will let you know.
