Pursuant to the Washington Public Records Act, I hereby request the following records:

1) Copies of all policies governing how professors, teaching assistants, or other educators may use Proctorio. For example, is use of the proctoring service optional? When can an educator report a student for cheating on an exam, based on evidence supplied by Proctorio? What is the appeal process for a student reported by Proctorio?

2) Copies of all policies given to students regarding their use of Proctorio.

3) Copies of all user manuals or guides provided by Proctorio, or the university, to professors, teaching assistants, or other educators regarding how to use Proctorio.

4) Copies of all promotional documents provided to the university by Proctorio in support of its efficacy (e.g., studies, whitepapers, etc.).

I ask that all fees be waived, as I am a journalist (examples of my work can be found at toddfeathers.com) and I intend to use the requested records to publish articles in the public interest and not for any commercial purpose.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

This email is provided in partial response to your public records request for records regarding the use of Proctorio.

Upon review, the Office of Public Records and Open Public Meetings has found certain items partially exempt from inspection and copying and has made the appropriate redactions per the following Public Records Act provision(s):

FERPA STUDENT PRIVACY
The University finds the student records responsive to your request exempt from inspection and copying. In so doing, the University cites the Federal Family Educational Rights and Privacy Act (FERPA). In prohibiting schools and institutions of higher education from releasing educational records without the consent of the student, the federal statute defines educational records as follows: "those records, files, documents, and other material which - (i) contain information directly relating to a student, (ii) are maintained by an educational agency or institution or by a person acting for such agency or institution." 20 U.S.C. 1232g(a)(4)(A); 34 CFR Part 99.

RCW 42.56.070(1) OTHER STATUTE
Each agency, in accordance with published rules, shall make available for public inspection and copying all public records, unless the record falls within the specific exemptions of RCW 42.56.070(8), this chapter, or other statute which exempts or prohibits disclosure of specific information or records.
