Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

All final statements issued by offenders executed by the State of Washington as listed here:

If this record exists in electronic form, I request that you not create a new record for me (e.g., by printing your electronic record then scanning it to make a series of images of the printed data) but provide the electronic record itself in its native format.

I also request that, if appropriate, fees be waived as I believe this request is in the public interest. The requested documents will be made available to the general public free of charge as part of the public information service at MuckRock.com, processed by a representative of the news media/press and is made in the process of news gathering and not for commercial usage.

In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Mr. Rodriguez:

You requested last statements for the individuals that have been executed in Washington State since 1904. You provided a link to the list of individuals executed since 1904 from our Washington State Department of Corrections (WADOC) website. I have attached the list for your convenience.

The Department does not record "last statements." The media witnesses who attend as part of our process create this record. From what I understand, a newspaper contact we have named Andy Porter (509) 526-8318 may have some of these records. Although we do not record last statements, I recently researched a similar request and identified one responsive last statement record for Turman Wilson and Utah Wilson in the form of an old newspaper clipping found in an archived file. This record is attached. I will research your request further. We have to request the archive files that are available within the DOC system and review each offender's file individually in order to identify responsive records, if any exist. I will update you with my research progress within the next 20 business days, on or before March 17, 2015.

Out of approximately 16 files of executed persons reviewed recently, only one file contained a last statement in the form of a newspaper clipping (provided to you February 17, 2015). In light of the fact that the Department does not keep a record of last statements and our limited results thus far, can you please confirm that you would like me to proceed with the ordering and review of the remaining archived files that are available? The process will take a few weeks.
