On February 17, 2016, I sent e-mail to your agency with a complaint about an experience I had earlier that day on a public train station platform next to a Sounder commuter train, during which someone appearing to be a conductor made to me the absurd claim that an unspecified policy prohibited photography of public staff on the job in a public place without explicit permission for such. I received a response to my complaint two days later, on February 19, from Roseanne Harrison-Smith at Sound Transit Customer Service. Ms. Harrison-Smith reported that she had forwarded my complaint to other Sound Transit staff and to BNSF Railway Company. On March 7, she wrote to me that the "policy that was quoted to [me] was incorrect" and that that it "was an outdated policy that used to be enforced as a security precaution, but was later modified to restrictions on photographing anything in the cab car." She also stated that "[a]s part of the policy modification, [Sound Transit] introduced checking the identification of the photographer instead of asking them to refrain."

Less than one hour after receiving the aforementioned e-mail from Ms. Harrison-Smith, I e-mailed to thank her and to request copies of both the old and new policies to which she had referred. Despite my request then and my follow-up e-mail on March 15, I have not received any further contact from her. I am left to wonder if her e-mail is malfunctioning or if she has simply ignored my request for specifics about the policies she cited in her e-mail to me.

Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request all e-mail and memoranda received by, sent by, or sent on behalf of Roseanne Harrison-Smith (Sound Transit Senior Customer Service Representative) since February 1, 2016.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

We have identified 1,782 responsive emails to your request for all emails and memos to and from Roseanne Harrison-Smith since 2/1/2016. In any event, the records in either format are too large to email (the pdf file is 157 MG - the pst file is 159,425 KB). Please send $3.75 to cover copy and mail charges for the responsive emails ($1.37 for the CD/DVD, envelope and mailer and $2.30 postage). Make your check payable to Sound Transit, 401 South Jackson, Seattle, WA 98104 and reference PD16-120 on your check. Once we receive payment we will copy the records to a CD/DVD and mail it to you. Please note we are not including 24 personal emails because they do not meet the definition of a public record under 42.56.010 as they do not relate to the conduct of government, and in any event would be also exempt under 42.56.230(3).

We are also withholding 1 email that has an attached routine employee performance evaluation with no discussion of misconduct and thereby has no legitimate interest to the public. This email and attachment are exempt under 42.56.230(3). (See also Tiberino v. Spokane County, 103 Wn App. 680, 13 P3d 1104 (2000)).

We have identified an additional 127 emails and attachments that relate to individual ORCA accounts. Some of the information contained in those emails will need to be redacted pursuant to 42.56.330. Once we have completed that process we will contact you again to provide you with those emails.

Lastly, we have identified an additional 16 emails that contain links to additional documents in our Customer Records Management System. We are pulling the responsive documents that follow those links and will provide you with those documents once we have collected them from the system.

We expect to have the next installment ready for you in the next 2-3 weeks.

If we do not receive payment or hear from you by May 11, 2016, we will conclude you no longer want access to the records and will close your request file.
