This extension is allowed by RCW 42.56.520 of the Public Records Act of Washington State. Dear Perry Tapper,

As you are undoubtedly aware the Washington Public Records Act requires that responses to requests for public records shall be made promptly by agencies. While the law allows for extensions to the five day statutory requirement under limited circumstances, I don’t think that anyone would consider a three month delay for what is effectively four email searches a prompt response.

I look forward to receiving these docs promptly and hope not to have to exercise my legal rights under RCW 42.56.550.

Dear Mr. Neiss:
I am writing to you in regard to your fax, received in our office on 05/24/2022.  In this fax, you note that you had mailed a check in the amount of $4.98 on 4/27/2022.
This check was in payment of the invoice we sent to you on 4/18/2022 and due on 5/9/2022.  To date, we have not received the aforementioned check.
In order for us to send you the CD containing the records responsive to your request, please resubmit payment for $4.98 (cost of CD, packaging, US postage as per invoice).
Alternatively, the University is piloting an online portal through which requesters can receive digital records.  The costs are $0.05 for every 4 files and $0.10 per GB.
Please let me know if you will be resending the check or if you would like to opt-in to the pilot program for online portal delivery of records.  If the latter, I will send you a revised invoice reflecting the cost adjustment.  Otherwise, we will assume you are no longer interested in the records and will close your request accordingly.
