Pursuant to RCW Ch. 42.56 (Public Records Act), I hereby request the following records:

The algorithm responsible for the early release of 3,200 inmates, as described by Gov. Jay Inslee on December 22, 2015.

Please include the complete software source code responsible for this error, preferably as a gzip'd tarball file or as a public source control repository.

Additionally, please include any and all documents related to the discovery, processing and remedy for this software error, including any briefings/memos made for Gov. Jay Inslee's press conference on the issue.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Hi Theresa, thank you for your swift reply!

I plan on appealing the exemption, but I will wait until the rest of the response is delivered on or before February 6, 2016 before I submit my paperwork.

Is there a time limit on when the appeal can be filed? If so, does that begin now, or when the rest of the response is delivered?

Actually, would mind if I submitted my PDU-39440 RCW 42.56.420(4) exemption appeal via email rather than the post? I think that would probably be a bit easier for both of us.

In the original request I reference a press conference given by Gov. Jay Inslee on December 22, 2015. He must have been prepped for this press conference with talking points, or meeting notes, etcetera - I am requesting those notes as they relate to the subject matter. Please send me all available materials created for the governor for this press conference - let's say, 5 days preceding this conference. Terms should include "3,200", "offender", "inmate", "release", "algorithm", "software", "glitch", and "bug". This may consist of emails, power point presentations, Word documents, or PDF files.

You should also expect an additional appeal for the PDU-39440 RCW 42.56.420(4) exemption shortly.

This is a follow up to the correspondence you received from Denise Vaughan regarding your appeal related to PDU-39440. A search is being conducted for records pertaining to the second portion of your request, which you clarified to be for documents provided to Governor Jay Inslee for his press conference on December 22, 2105. You ask for all talking points, meeting notes, emails, power points presentations, word documents, or PDF files created for the press conference for five days preceding the conference. Also, you asked that search terms include "3,200", "offender", "inmate", "release", "algorithm", "software", "glitch", and "bug".

In your original request received on December 23, 2015, in the same sentence that you asked for records related to Governor Jay Inslee's press conference, you also asked for any and all documents related to the discovery, processing and remedy for "this" software error. Please confirm if you still want to receive such records.

Staff are in the process of conducting a search with the above criteria. You may expect further correspondence regarding PDU-39440 within 20 business days, on or before April 5, 2016. If you should have any questions in the interim, you may contact me via email or at the address below.
