Thanks for getting in touch! Regarding your points of clarification, I have a few small issues. I'm okay with clarifying the request to exclude news spam, etc. that mentions ALEC, but I am actually very interested in any amicus briefs and communications of that nature.

That being said, I suppose that an amicus brief from ALEC would fall under the first category (communications between ALEC and the AG). Am I correct in thinking this? If so, I would be happy to approve the clarifications as they are.

Hello, thank you for your quick reply. You are correct, that any communication between the American Legislative Exchange Council and the Attorney General’s Office would fall under category 1 of your request and any records found in response to this item would be provided under that category.

I interpret your reply below in which you state, “I'm okay with clarifying the request to exclude news spam, etc.” that you do not wish to receive communications we may receive from news outlets that may reference the American Legislative Exchange Council (ALEC).

Also, we have interpreted your request for the term ALEC to be a request for the acronym of the American Legislative Exchange Council and not the name of an individual party, such as, Alec.

There may potentially be a large volume of communications that mention the American Legislative Exchange Council as a case law citation. An example of this could include other legal briefings or communications that our office may be working on that reference ALEC case law citations. Do you wish to receive communications that are not specifically about the American Legislative Exchange Council but reference case law related to ALEC?

Please notify me right away if you disagree with our interpretation of your request or clarification. I look forward to working with you on the clarification of the documents you are requesting. Thank you for your attention to this email.

Hi Natasha,

Thanks, I think you got it perfectly!

I'm interested in seeing how ALEC influences the creation and interpretation of state level laws, so an Amicus Brief that ALEC created or provided is interesting. However, you're right in thinking that I'm not interested in comms that mention ALEC in a tangential fashion, like a case law citation. Any of those can safely be excluded.

We have one sentence of a real estate offering memorandum that references a state’s economic competitiveness ranking with the American Legislative Exchange Council’s State Economic Competitiveness Index. There are no other references to ALEC within this document. Are you interested in receiving this type of document?
