Pursuant to the Washington Public Records Act, I hereby request the following records:
1. User manuals or documentation of SAP Business Objects and/or SAS used internally for managing ORCA data
2. User manuals or documentation related to ORCA card hardware owned by ORCA (e.g. validators)
3. Agency policy, guidance, or vendor agreements that address data sharing and interoperability between Vix and the makers of the ORCA card vending machines (Schiedt & Bachman)
4. Document listing names of "universes" and "fields" available in the SAP Business Objects application
5. Emails between employees of Sound Transit/ORCA and Vix regarding agency access to data for the Data Access and Reporting warehousing effort.
6. Requests for proposals, proposals submitted by vendors, and contracts, for the Next Gen ORCA system.
7. Any Sound Transit or ORCA retained documents describing the functioning of the "back office" reporting system, which has been described to me as owned by ORCA.
I also request that, if appropriate, fees be waived as I believe this request is for my PhD research at the University of Washington. These documents are to support to my PhD dissertation research in which I ask, "How do public transportation agencies work with private firms to enable policy programs that rely on continuous or geospatial data? What contextual and historical factors led to current system design and institutional configurations? How do stakeholders define the roles of their respective organizations?" In the event that fees cannot be waived, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

We may need to provide these records on an installment basis pursuant to RCW 42.56.080. Given our staffs' workload and the number of requests we are currently working on, we estimate that it will take another 5-6 weeks to identify and gather responsive records. INIT marked its proposals as confidential and provided a redacted version that is available for release. If you would like the unredacted version, please let us know as soon as possible since we must notify INIT of your request and provide it the opportunity to protect the information it has marked proprietary and/or confidential from release. This third party notification process may include court action and may take an additional three to four weeks.
If you do not want the unredacted version, please send $5.15 to cover copy and mail charges. Make your check or money order payable to Sound Transit, 401 S. Jackson St., Seattle, WA 98104 and reference PD19-355 on your check/money order. Once we receive payment we will copy the records to a CD and mail it to you. If you would rather review the records here at Sound Transit, please contact me to schedule an appointment during normal business hours. If we do not hear from you or receive payment by May 5, 2019, we will conclude you no longer want these documents and will close this file.

We have identified responsive documents to items 1, 4 and 7 of your request. The ORCA contractor (Vix Technology) has requested third party notice before release of these documents. In response to third party notice we provided, Vix’s attorneys are requesting a copy of the documents as well as two weeks to review and determine if Temporary Restraining Order is necessary or not. The time for Vix to review has been changed to November 13, 2019.
If we do not hear from Vix’s attorneys by close of business on November 13, 2019, we will release the records to you. In any event, we will contact you again by November 15, 2019.
