1) All emails exchanges–including incoming messages, outgoing messages, forwards, and attachments–between the department's chief/commissioner and ShotSpotter representatives since January 1, 2021. ShotSpotter representatives can be identified by searching the department's email system for addresses ending in "@shotspotter.com."

2) All emails exchanges–including incoming messages, outgoing messages, forwards, and attachments–between the department's public information and/or media relations staff members and ShotSpotter representatives since January 1, 2021. ShotSpotter representatives can be identified by searching the department's email system for addresses ending in "@shotspotter.com."

I ask that all fees be waived as I intend to use the requested records to further public understanding of government functions and not for any commercial purpose.

In the event that you choose to withhold or redact the records, I ask that you provide a detailed explanation of the statutory and/or case law upon which each rejection or redaction is based.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

Upon review, it is not clear as to exactly which records are requested in this FOIA request, as while it provides certain search parameters, it does not include a description of a particular matter covered by, or a particular subject of, the records that you seek, which is required to perform a reasonable and adequate search for responsive records.

Please provide a revised description of what specific records are sought in this FOIA request. If you no longer have a need for the records you seek, no further response is needed because after five (5) working days we will interpret nonresponse as a request for withdrawal, and close our file on the request.

Hello Bob,

I believe I've adequately described these records—it should be pretty easy for your IT folks to search the department's email client system for emails between the department employees I identified and email addresses ending in "@shotspotter.com." This is a routine way of searching for emails.

The Freedom of Information Act does not require a "description of a particular matter covered by, or a particular subject of, the records that you seek." I have identified the senders and recipients of the emails and the time frame, which is all the information you need to conduct a search.

Please confirm you are processing this request. If you intend to deny it, I ask that you cite the specific exemptions under which you are withholding the records, as required by law.

Hello Mr. Feathers,

As I received no response to my request for clarification, the request was closed. As it was closed because I received no response, it was not a denial.

Nevertheless, I have just now noticed your message in FOIAXpress and we will proceed to do a search in this case, although the search will take time as MPD must coordinate with an outside agency to do the search.

Additional time will be required to review any records located for responsiveness, and for material that may be exempt from release under the District of Columbia FOIA, and to coordinate with other components or agencies that may have an interest in the disposition of such records.

Dear Mr. Feathers:

This is in response to your Freedom of Information Act (FOIA) request for: "1) All emails exchanges-including incoming messages, outgoing messages, forwards, and attachments-between the department's chief/commissioner and ShotSpotter representatives since January 1, 2021. ShotSpotter representatives can be identified by searching the department's email system for addresses ending in "@shotspotter.com." 2) All emails exchanges-including incoming messages, outgoing messages, forwards, and attachments-between the department's public information and/or media relations staff members and ShotSpotter representatives since January 1, 2021. ShotSpotter representatives can be identified by searching the department's email system for addresses ending in "@shotspotter.com."".

A search located 94 pages of records, in the attached two files, responsive to this FOIA request. Upon review, I have determined to withhold portions of the released records pursuant to D.C. Official Code § 2-534 (a)(2), which exempts personal privacy information, the release of which would constitute a(n) (clearly) unwarranted invasion of personal privacy. The withheld information includes names/personal identifiers and other personal privacy information, including that which would lead to the identity of individuals.

There are no charges for FOIA services, in this instance.

Please know that, under D.C. Official Code § 2-537 and 1 DCMR § 412, you have the right to appeal this letter to the Mayor or to the Superior Court of the District of Columbia. If you elect to appeal to the Mayor, your appeal must be in writing and contain "Freedom of Information Act Appeal" or "FOIA Appeal" in the subject line of the letter as well on the outside of the envelope. The appeal must include (1) a copy of the original request; (2) a copy of any written denial; (3) a statement of the circumstances, reasons, and/or arguments advanced in support of disclosure; and (4) a daytime telephone number, an e-mail and/or U.S. mailing address at which you can be reached.

The appeal must be mailed to: The Mayor's Office of Legal Counsel, FOIA Appeal, 1350 Pennsylvania Avenue, N.W., Suite 407, Washington, D.C. 20004.
