Pursuant to the District of Columbia Freedom of Information Act of 1974, D.C. Code Ann. § 2-531 et seq. ("D.C. Act"), I hereby request the following records:

- Use of Force Incident Reports (PD Form 901-e) filed by MPD canine handlers from Jan 1. 2015 through Dec. 27, 2015.

- All Tactical Use of Canine Reports (PD Form 906) filed by MPD officers from Jan. 1, 2015 through Dec. 27, 2015.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Dear CJ Ciaramella,
This office is in receipt of your Freedom of Information Act (FOIA) request. Your FOIA Request Number is 2016-FOIA-02107. Your assigned FOIA Specialist is Genet Amare. Pursuant to D.C. Official Code § 2-532, we have fifteen (15) business-days, subject to the possibility of a ten (10) business-day extension, to respond to the request as of the date of receipt.  More specifically, D.C. Official Code § 2-532(c) and (d) state:
(c) A public body, upon request reasonably describing any public record, shall within 15 days (except Saturdays, Sundays, and legal public holidays) of the receipt of any such request either make the requested public record accessible or notify the person making such request of its determination not to make the requested public record or any part thereof accessible and the reasons therefor
(d) In unusual circumstances, the time limit prescribed in subsection (c) of this section may be extended by written notice to the person making such request setting forth the reasons for extension and expected date for determination. Such extension shall not exceed 10 days (except Saturdays, Sundays, and legal public holidays). For purposes of this subsection, and only to the extent necessary for processing of the particular request, "unusual circumstances" are limited to: (1) The need to search for, collect, and appropriately examine a voluminous amount of separate and distinct records which are demanded in a single request; or (2) The need for consultation, which shall be conducted with all practicable speed, with another public body having a substantial interest in the determination of the request or among 2 or more components of a public body having substantial subject-matter interest therein.

Mr. Ciaramella:

While your original request was dated December 27, 2015, it was not sent to me as the MPD FOIA Officer or submitted via our online portal; accordingly, it was not properly submitted. Nevertheless, we accommodated you by processing the request when it was forwarded to us in February. The response to the request is not due until tomorrow. I anticipate that we will be exercising an extension in order to respond to the request.
