Pursuant to the DC Freedom of Information Act, I hereby request the following records:

Copies of any internal manuals, instructions, forms or checksheets for how the law enforcement agency processes records requests.

I am a member of the news media and request classification as such. I have previously written about the government and its activities, with some reaching over 100,000 readers. As my primary purpose is to inform about government activities by reporting on it and making the raw data available, I request that fees be waived.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 15 business days, as the statute requires.

Photocopies: $0.25 per page

Document certification: $1.00 per document to certify a document as true copy of an agency record
*
The direct cost of any service or material for which no fee has been established

Please be aware that you may have to pay search and/or review fees even if the search does not locate any responsive records or if records are located but are withheld as exempt. See DC Official Code § 2-532 and 1 DCMR § 408.
A cursory review of your request indicates the fee for processing this request will be in excess of $50.00.
Please advise this office within five (5) business days from the date of this notification, your willingness to pay. In the meantime your request will be placed on hold pursuant to 1 DMCR § 405.6. If MPD does not receive your response within five (5) business days from the date of this notification, it will presume that you are no longer interested in pursuing your request and will close the request as constructively withdrawn

This e-mail is in response to the above referenced Freedom of Information Act (FOIA) request for the following:

Copies of any internal manuals, instructions, forms or check sheets for how the law enforcement agency processes records requests.

Please find attached, documents deemed responsive to your request. Be advised, some pages of the documents contain names of Metropolitan Police Department members. A release of such information would constitute as a clearly unwarranted invasion of personal privacy and is exempt from disclosure pursuant to D.C. Official Code § 2-534(a)(2). In addition please see the following link to obtain a copy of General Order 204-04 (Freedom of Information Act Requests: https://mpdc.dc.gov/page/written-directives-general-orders.

Please know that, under D.C. Official Code § 2-537 and 1 DCMR § 412, you have the right to appeal this e-mail to the Mayor or to the Superior Court of the District of Columbia. If you elect to appeal to the Mayor, your appeal must be in writing and contain "Freedom of Information Act Appeal" or "FOIA Appeal" in the subject line of the letter, as well as, on the outside of the envelope. The appeal must include (1) a copy of the original request; (2) a copy of any written denial; (3) a statement of the circumstances, reasons, and/or arguments advanced in support of disclosure; and (4) a daytime telephone number, an e-mail and/or U.S. mailing address at which you can be reached.
