Dear Sir / Madam,

I am writing to ask for your help with a request under the Virginia State Open Records Law, Va Code sec §2.2-3700 - §2.2-3714.

Would it be possible for you to send me a copy of any records that would show some or all of the following information:

1. A list of ALL types of alternative asset investments, including private equity, venture capital, distressed debt, mezzanine, fund of funds, infrastructure, natural resources, real estate and private debt partnerships in which Virginia Retirement System is an investor; and
2. For each partnership, may I please have a copy of any alternative assets investment records that would show some or all of the following information:

a. Virginia Retirement System's total commitment to the partnership,
b. the total contributions made by Virginia Retirement System to the partnership to date,
c. the total distributions received by Virginia Retirement System from the partnership to date,
d. the estimated current value of Virginia Retirement System's holding in the partnership, and
e. any available estimates of the Net and Gross IRR earned by Virginia Retirement System to date on its investment in the partnership.

3. In addition to this could you please provide me with an up to date account of your current asset allocations in the above asset classes including any direct investments you may have.

Thank you very much for your attention to this request. In the event that Virginia Retirement System has no such investments, a simple note to this effect will suffice. We understand that we may be charged for the cost of the copies requested, and agree to pay these charges.

This is in response to your Virginia Freedom of Information Act (FOIA) request received November 29, 2021 following the state holiday. FOIA, §2.2-3704(A) of the Code of Virginia, provides that access to public records is available only to citizens of the Commonwealth, representatives of newspapers and magazines with circulation in the Commonwealth and representatives of radio and television stations broadcasting in or into the Commonwealth. As you do not appear to be a Virginia citizen nor a representative of a newspaper, magazine, radio or television station, your request does not qualify under the provisions of the Virginia FOIA.

Ms. Parker and Mr. Nash, this is in response to your Virginia Freedom of Information Act (FOIA) request, received December 2, 2021. FOIA requires a response to requests within five business days following receipt of the request (§ 2.2-3704(B) of the Code of Virginia), in this case by December 9, 2021. However, VRS has determined that it is not practically possible for us to respond to your request within five business days of the receipt of your request as required by FOIA. Under these circumstances, § 2.2-3704(B)(4) of the Code of Virginia allows an agency an additional seven business days to respond to your request in addition to the initial five business days following receipt of your request, by December 20, 2021.

Please note, our Information Technology department has not cleared the MuckRock portal for use. Please also note that, since neither MuckRock nor Ms. Parker are eligible requesters under Virginia FOIA, VRS requires the email address of the Virginia resident who is making the request so that we can provide the information to the Virginia resident. I will send the information via Mr. Nash’s email.
