Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

1) All contracts, memorandums of understanding, data privacy agreements, and comparable agreements between the department and Qlarion regarding the Framework for Addiction Analysis and Community Transformation (FAACT) program.

2) All contractor statements of work or project overview documents regarding the creation and maintenance of the FAACT program.

3) A data dictionary/library for the FAACT database. A data dictionary/library is a document that lists the available data fields within a database. It does not contain the actual data.

I ask that all fees be waived as I am a journalist and intend to use the requested records to publish articles in the public interest. In the event you choose to impose fees, I request a detailed breakdown of the fees, including the hourly wage of each employee involved and an explanation justifying the employee hours required to fulfill the request.

Should you choose to reject this request or redact portions of it, I ask that you provide a detailed breakdown of the statutory exemptions and associated case law underlying your decision to withhold each/any portions from public review.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Dear Tom Nash and Todd Feathers,

In response to the FOIA request you made, I have I have attached the
documents you requested. I have a few clarifying questions (see underlined
questions below) to ensure we respond fully to your request.

In response to your first request for "All contracts, memorandums of
understanding, data privacy agreements, and comparable agreements between
the department and Qlarion regarding the Framework for Addiction Analysis
and Community Transformation (FAACT) program," I have attached:

- DCJS's current contract with Qlarion (FAACT FY22 Exhibit D-8 Signed
and Executed 9.13.21). Each year there is a new contract signed. * Are
you also requesting all previous contracts*?
- Qlarion's contract with the Virginia Information Technologies Agency.
(VA-150915-QLA). The DCJS contract with Qlarion is part of a larger
enterprise solutions contract that Qlarion has with Commonwealth.
- DCJS's contract with the Department of Behavioral Health and
Developmental Services (DBHDS) (2021 1001 SFA 832960203DCJS - DBHDS
Executed). DBHDS has provided grant funds for the expansion of FAACT since
its initial development.
- The Data Trust Agreement that was developed by the Chief Data Officer.
(DCJS Commonwealth Data Trust Member Agreement Amendment and DCJS DTA-Fully
Executed 2020.10.22). Each agency that participates in FAACT is required
to have a Data Trust Agreement with the Chief Data Officer. While DCJS
funds the expansion of FAACT, the operations and maintenence of FAACT is
now coordinated by the Chief Data Officer.

In response to your the second request for "All contractor statements of
work or project overview documents regarding the creation and maintenance
of the FAACT program," I have attached:

- Qlarion's December 2021 Invoice (Invoice 86408_VADDCJS_EP3389236_Dec
2021)
- the report Qlarion produced in conjunction with the invoice (2021
December Invoice Deliverable Report), and
- the December 2021 FAACT Status Report (FAACT Status Report
112921-122721)

Qlarion produces such deliverable reports and status reports every month or
every few months. *Are you requesting all such invovices and reports?* Is
there a certain time frame? Pulling old documents could take several hours
of work, depending on the timeframe requested.

In response to your third request for " A data dictionary/library for the
FAACT database. A data dictionary/library is a document that lists the
available data fields within a database. It does not contain the actual
data,"
I have attached the Data Dictionary for the data sets DCJS proivdes to
FAACT. (Data Dictionary - PTCC and DFS)

If you have further questions about the project, please do not hesitate to
reach out to me directly. I also took the liberty to resopnd to this
request via email rather than using the link you provided. As part of our
data security protocols, we have been advised not to use websites that we
are unfamiliar with. Please let me know if you are unable to receive these
