Under FOIA, UVA has five working days to respond to your request.  You can expect to receive an initial response by 7/17/2019.  If it is not practically possible to provide the requested records or to determine their availability within five working days, FOIA allows for UVA to request an additional seven working days.  Va. Code § 2.2-3704(A)(4).  If additional time, beyond the seven-work-day period, is needed in order to fulfill your request, we will make reasonable efforts to reach an agreement with you for records production as required under FOIA.  Va. Code §§ 2.2-3700 and 2.2-3704(C).
Additionally, UVA may recover its actual costs incurred in processing your request.  This includes costs incurred in accessing, duplicating, supplying, or searching for the records you have requested, including, but not limited to, the costs of reviewing records to determine whether or not they are public records responsive to your request, exempt under FOIA, or may not lawfully be disclosed pursuant to some other provision of law (See Va. Code §2.2-3704(F)).
If costs are likely to exceed $200, as permitted by FOIA, we do require advanced payment prior to fulfilling a request.  Va. Code § 2.2-3704(H).  If costs are likely to be less than $200, actual costs incurred by UVA will be billed to you after you receive your response.  In either case, I will let you know of any costs in advance.

Code §2.2-3704(A), “all public records shall be open to citizens of the Commonwealth, representatives of newspapers and magazines with circulation in the Commonwealth, and representatives of radio and television stations broadcasting in or into the Commonwealth during the regular office hours of the custodian of such records.”

Virginia law permits the University to recoup costs from you related to staff time and resources involved with FOIA requests. Va. Code § 2.2-3704(F). Thus, the University is providing a cost estimate related to this request. This cost estimate will take part in two stages. First, the University will conduct an email search of 33 custodians of records from the University Police Department. The average cost to the University for searching a single email account is $150. Second, after the email search is performed, we will then be able to estimate additional time and costs for reviewing records to confirm whether or not they are responsive to your request, and to ascertain whether the responsive records contain exempt information to be redacted under FOIA, or may not lawfully be disclosed pursuant to some other provisions of law. Virginia Code Section 2.2-3704(F). This search will incur additional recoverable costs, which we cannot reasonably estimate until we know the scope of collection that results from Step 1. Thus, for this request for Step 1, preliminary costs are $4,950. Since estimated costs exceed $200, we require advanced payment as permitted by FOIA. Once we receive the advanced payment, the University will conduct the email search and alert you to an estimate for Step 2 of this process.
