To Whom It May Concern:
Pursuant to Virginia Freedom of Information Act, I hereby request the following records:
I request documentation of all cases brought to court involving Special Conservators of the Peace (SCOPs). These may include but not be limited to:
-Cases where an SCOP was involved in the apprehension or arrest of a defendant or suspect
-Cases where an SCOP was implicated or accused of committing a crime (felony, misdemeanor, or infraction).
Please limit responses to those cases filed between 2012 and the date this request is processed.
Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.
To Whom It May Concern:
This email should not be used for requests from the Court. You need to send all requests in writing to the address listed below. This is my personal email and I may not get to look at it everyday if I am tied up in Court or in meetings so in order to have timely responses you must send written requests to the Circuit Court Clerk's Office because the mail is opened and processed daily. Please also read the following: Under Virginia law, the records of the Clerk are exempted from FOIA under subdivision A5 of Section 2.2-3703 of the Code of Virginia. The records of the Clerk are public records under Section 17.1-208 of the Code of Virginia and are made available to the public for inspection with any copies provided to the requester subject to the fees set out in Section 17.1-275 (A) (8) of the Code of Virginia. I realize you are out of state and may be unfamiliar with Virginia Law. Please also note that in order to research any record, we must have a name or case number in order to look up cases.
I did ask our Commonwealth's Attorney, if they could recall any such charges in the past few years that a SCOP was involved in and we have not had any to their knowledge so I hope this helps you in your search. We are a really small jurisdiction and our Judge's never appoint SCOP's as they feel the Police Department and Sheriff's Department take care of law enforcement. Good luck in your search and have a great day.
Sincerely, Tamara J. Ward, Clerk
