Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

I am requesting digital copies in PDF format of engineering plans related to the new construction roadway with the UPC 109299 that is scheduled to start on October 27, 2021. The manager for this project is Robert Strevell.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

This request is filed by Tom Nash, a citizen of Virginia, in coordination with James Robbins.

The Virginia Department of Transportation received your Freedom of
Information (FOIA) request for engineering plans for nine projects. Please
be advised section 2.2-3704 (A) of the *Code of Virginia* grants rights of
access to public records to citizens of the Commonwealth. Since you are a
citizen outside of the Commonwealth, we are denying your request for
records. If you have a valid Virginia mailing address, please provide that
information so that we may proceed with your request. The email sent
provides an address out of state. If Mr. Nash has a Virginia address,
please provide that information in order to proceed with this request.

For your reference, I am providing you a copy of section 2.2-3704 (A) of
the *Code of Virginia* below.

*CODE OF VIRGINIA*

*ยง 2.2-3704. Public records to be open to inspection; procedure for
requesting records and responding to request; charges; transfer of records
for storage, etc.*

*A. Except as otherwise specifically provided by law, all public records
shall be open to citizens of the Commonwealth, representatives of
newspapers and magazines with circulation in the Commonwealth, and
representatives of radio and television stations broadcasting in or into
the Commonwealth during the regular office hours of the custodian of such
records. Access to such records shall be provided by the custodian in
accordance with this chapter by inspection or by providing copies of the
requested records, at the option of the requester. The custodian may
require the requester to provide his name and legal address. The custodian
of such records shall take all necessary precautions for their preservation
and safekeeping.*
