Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

Virginia Fusion Center FOIA logs for years 2017, 2018, 2019 (if any exist for those years).

I would prefer the logs to be provided in the format used by the Virginia Fusion Center.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Mr. Nash,

Thank you for your correspondence to the Virginia Department of State
Police (the Department). As you may be aware, requests for records of the
Commonwealth, its agencies and political subdivisions are governed by
the *Virginia
Freedom of Information Act* (FOIA), §§ 2.2-3700 *et. seq.* of the *Code of
Virginia*.

Pursuant to Virginia Code § 2.2-3704(B)(3), the requested records "*Virginia
Fusion Center FOIA logs for years 2017, 2018, 2019*" could not be found or
do not exist in the Department's files. Furthermore, Virginia Fusion
Center materials
constitute records relative to criminal intelligence or any terrorism
investigation and are governed by specific statutory authority and are
excluded from the provisions of FOIA pursuant to Virginia Code § 52-48.

We regret we are unable to assist you further in this matter but hope the
information provided is helpful.

Hello,

Could you clarify if the requested records do not exist at all, anywhere, or if the records only do not exist in the Department’s files?

In the event that the requested records do not exist at all, is it the policy of the Virginia Fusion Center not to track public records requests submitted to the Center?

Mr. Nash,
It is common practice within the Department of State Police for all FOIA
requests to be forwarded to the Legal Office for processing. The Legal
Office tracks the requests Department-wide in spreadsheet format, which
were provided to you February 28, 2020.
