To Whom It May Concern:

Pursuant to the Virginia Freedom of Information Act, I hereby request the following records:

Any responsive documents provided to Timothy Heaphy/Hunton & Williams in response to a FOIA request submitted on September 15, 2017.

For reference, please see this previous request which also requested the responsive documents, but none were provided: https://www.muckrock.com/foi/virginia-128/foia-request-copy-of-any-foia-requests-submitted-by-timothy-heaphy-and-hunton-williams-92742/

Note: As Hunton & Williams already paid all associated fees with the responsive documents and the documents were previously redacted, there should be no further charges or redaction necessary.

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

Please note that I am a citizen of Virginia, and am using MuckRock's services to help manage and track my request.

Sincerely,

Tom Nash

Hi there

A message was sent to you regarding record request #20-4568:

Please be advised that a portion of the responsive documents, namely the redacted documents sent to Mr. Heaphy, were stored digitally. Unfortunately, the medium containing the digital record has corrupted in the time since the response to Mr. Heaphy in 2017. As such, the redacted version of the records is not available.

Please be aware that all of the documents utilized to produce the redacted record sent to Mr. Heaphy are still available in unredacted form. In order to produce those records to you, the records will have to be redacted once again. This office is willing to redact the documents for you at no cost. However, the nature of the redactions for the 2017 request was voluminous and expended considerable manpower. As such, in order to produce the documents in redacted form you will have to agree to a minimum of 6-8 weeks time with an agreement for necessary extensions in advance. This time frame is necessary to accommodate the current volume of FOIA related work and the unfortunate delays caused by the coronavirus situation.

I appreciate your understanding in advance. Please advise if you agree to the time frame referenced above and I will have staff begin work.
