Pursuant to Virginia Freedom of Information Act, I hereby request the following records:

Documents concerning IMSI catchers or any of the following words: "Stingray", "cell site simulator", or "dirtbox". including:
-Contracts with the Harris Corporation regarding the acquisition of their Stingray or KingFish IMSI catchers
-Department policies and procedure regarding the use of IMSI catcher technology
-policies and procedures on the keeping of statistics about the Department's use and acquisition of IMSI catchers

The requested documents will be made available to the general public, and this request is not being made for commercial purposes.

In the event that there are fees, I would be grateful if you would inform me of the total charges in advance of fulfilling my request. I would prefer the request filled electronically, by e-mail attachment if available or CD-ROM if not.

Thank you in advance for your anticipated cooperation in this matter. I look forward to receiving your response to this request within 5 business days, as the statute requires.

On November 14, 2016, I notified you via email that we were exercising our right to an additional seven (7) business days to prepare a response to your request.

In your November 9, 2016 email, you requested the following:

As you may be aware, requests for records of the Commonwealth, its agencies and political subdivisions are governed by the Virginia Freedom of Information Act (FOIA), §§ 2.2-3700 et. seq. of the Code of Virginia.

In response to the first item of your request, the following information is provided. Copies of purchase order documents related to the purchase of two (2) Digital Receiver Technology (DRT) "dirtbox" cell site simulators.

In response to the second item requested, the following information is provided. Copies of §19.2-70.3 of the Code of Virginia and the Department policy regarding the use of the Mobile Device Support Vehicle.

In response to the third item of your request, there are no policies and procedures for keeping statistics about the use of IMSI catchers; however, a copy of the Mobile Device Support Vehicle use log is provided. The identity of Department personnel operating the vehicle has been redacted pursuant to §2.2-3706, paragraph A, 2, j.
